In the era of rapid Internet transactions,"Internet + food" has become one of the main ways of mass food consumption,and it is the inevitable result of the development of the Internet economy.The emergence of online food sales has brought us a lot of conveniences,but also brought new problems,threatening consumers’ right to life and health.The government has repositioned the legal status of third-party platforms for online food sales in response to problems that have arisen or may arise in online food sales,and has enacted some laws,regulations and rules to provide a legal basis for government regulation of third-party platforms for online food sales.However,the government still has some problems in the regulation of the platform,which hinders the safe and healthy development of online food safety.It needs to amend the government’s regulatory tools and regulatory methods from the aspects of legislation,law enforcement and judiciary.On the basis of improving the government’s own capabilities,it explores new regulations for cooperation with the platform mode.From the perspective of administrative rule of law,this paper focuses on the theme of government regulation of third-party platform for online food sales,and divides the article into four aspects: government regulation status,reality existing problems,government power theory and perfect government regulation.In the field of online food regulation,the government’s regulation of third-party platforms for online food sales is based on the relevant laws,regulations and rules such as the Food Safety Law,the Measures for the Investigation and Treatment of Internet Food Safety Violations,and the Measures for Food Safety Supervision and Administration of Internet Catering Services.It has formed the government’s legal system for the third platform regulation of online food sales,and has its regulatory characteristics.At the same time,the government has supervised the network food safety process to form a unique form of platform supervision,and complete the government’s pre-,post-,and post-regulation of the third-party platform for online food sales.At present,the government has some problems in the regulation of third-party platforms for online food sales.In the process of regulation,not only the government has over-regulated some aspects of the third-party platform for online food sales,but also has some aspects of insufficient regulation.The third-party platform also has non-performance obligations and no responsibility for the implementation of the government regulation system.Government regulation has not achieved the expected results,and online food safety problems are prone to occur.In fact,the regulation of third-party platforms for online food sales requires the government to give full play to government functions,exercise government power,and assume government responsibilities.The government’s regulation of market order and civil rights protection functions involved in the regulation of third-party platforms for online food sales,the government’s power content and power exercise,as well as the government’s legislative and law enforcement responsibilities,require the government to practice in regulation.On the basis of the existing legal system and government regulations,improve the government’s regulation of third-party platforms for online food sales,adhere to the basic principles of administrative law,rationally set platform obligations and responsibilities,innovate government regulatory tools,and establish incentive compatibility mechanisms and governments and platforms.The cooperative governance mechanism guarantees network food safety while realizing the government’s regulation of the platform.
