Research On The Legal Issues Of Heterogeneous Artificial Childbearing

The development of economy drives the progress of science and technology,and the emergence of human assisted reproduction is undoubtedly an important initiative with epoch-making significance.With the growing maturity and wide application of heterogeneous artificial reproduction technology,problems will arise.This paper will focus on the identification of parent-child relationship and related legal issues for analysis and discussion,and strive to sort out a clear context,to provide help to solve the identification of parent-child relationship.The first chapter is the introduction of the case and the focus of the dispute.This chapter selects two classic cases,through the description of the case leads to three controversial focus.The second chapter is the overview of heterogeneous artificial childbearing.This chapter first introduces the topic of artificial childbearing,and then discusses the concept of heterogeneous artificial childbearing children,and through different theories to identify the parent-child relationship of children born in this way,highlighting the particularity and necessity of heterogeneous assisted reproduction.The third chapter mainly analyzes the identification of parent-child relationship during the normal existence of husband and wife relationship.This paper analyzes the parent-child relationship of three different types of artificial children from the different situations of consent,revocation and defect.The fourth chapter is about how to identify the relationship between parents and children after the termination of the relationship.This chapter makes a detailed analysis from three aspects: the wife was pregnant before her husband died,the wife carried out heterogeneous artificial assisted reproduction according to her husband's wishes and the wife carried out artificial assisted reproduction without her husband's consent.The fifth chapter is the legal issues involved in the donor.First of all,this chapter defines the legal status of the donor,introduces the principle of anonymity of the donor and the right to know of the children of heterogeneous artificial childbearing,and further determines the relationship betwn the donor and the children of heterogeneous artificial childbearing,so as to determine the subjeeect of responsibility in the misuse of other reproductive cells and children suffering from specific diseases.
