Implementation Status And Legislative Improvement Of Grass-animal Balance Management System

After the "Grassland Law of the People's Republic of China" was promulgated in1985,the legal system for grass-animal balance management was established.Until2005,the "Grass-Animal Balance Management Measures" was promulgated to concreteize the grass-animal balance management legal system.The research on the legal system of grass-animal balance management has a long history,but from the current research status,it can be seen that the research is focused on the field of practice,the accounting of the livestock-carrying balance of grass-animals,and the problems in the balance of grass-animals.The grass-animal balance management system itself has rarely been studied.The grass-animal balance management legal system has more emphasis on the operability of measures in the establishment of the system.And the legal principles of the system itself have not been fully considered,which makes it difficult to achieve a grass-animal balance management system in practice.However the realization of the goal of grass-animal balance management should not only start with the study of technical specifications,but should be controlled at the level of system establishment and the specific implementation of management measures.The core problem studied in this article is the legislative perfection of the legal system of grass and livestock balance management.The research in this article starts from the theoretical and practical aspects of grass-animal balance.Based on the legitimacy and rationality of the grass-animal balance management system and its measures.Also the research is based on the issue of the balance between the running of government administrative power and the herdsmen's autonomy and the position of herdsmen's livelihood in the grass-animal balance management.It is found in the research that the grass-animal balance management system has institutional defects such as the lack of legal basis for grass-animal balance incentive measures,neglect of herdmens' right to live,and the lack of a grass-animal balance compensation system at the level of law.During the implementation of the system,there are problems such as the rigidity of grass-animal balance management measures,the implementation of the legal system of grass-animal balance management,the ecological protection effect is not achieved,and the grass-animal balance management legal system does not consider the livelihood of herdmens.Aiming at the above problems in the system and in the implementation process,this paper gradually sorts out the legislative purpose,legal basis of the legal system of grass-animal balance management and its implementation in practice through literature research,empirical research,and summary methods.situation.Through the comparison of the expected effect and the implementation effect of the grass-animal balance management system,the deficiencies in the implementation of the grass-animal balance management legal system are analyzed.After theoretical research,the theoretical basis of the legal system of grass-animal balance management was clarified.Through the analysis of the theoretical and practical aspects of the legal system of grass-animal balance management,the shortcomings of the legal system of grass-animal balance management are improvedby legislation,and the legal system of grass-animal balance management is standardized.Compared with previous research,this paper adopts a combination of theory and practice to support the theory with data through in-depth investigations,and uses a perfect theoretical system and rigorous arguments to cautiously propose suggestions for legal amendments and system implementation in practice.It is hoped that this research result will contribute its own contribution to the restoration of grassland ecology and livelihood protection of grassland herders.
