Investigation And Research On The Legal System Of Grassland Contract Management In Pastoral Areas Of Gansu Province

China's rural land contracting methods are divided into household contracting within rural collective economic organizations and contracting through auction,auction,public consultation,etc.This topic mainly studies household contracting within rural collective economic organizations.This paper investigates and analyses the implementation status of grassland contractual management legal system in pastoral areas of Gansu Province,and puts forward some suggestions to improve the legal system of grassland contractual management in view of the existing problems.This research adopts a combination of law and sociology to conduct research in the main pastoral areas of Gansu Province through empirical investigation,literature research,and data analysis.It is found that the grassland contracted management system in Gansu Province has achieved remarkable results.However,due to the particularity of grassland which is different from arable land,the legal system of grassland contractual management in pastoral areas of Gansu Province has appeared,such as single contracting subject and mode of operation,limited transfer of contractual management rights,and the contradiction between grassland contractual management right and grassland ecological protection is prominent.Therefore,in order to adapt to the particularity of grassland management and respect the collective choice of herdsmen,it is necessary to comprehensively apply the rule of law to solve the above problems.Therefore,the author puts forward the following suggestions: to supplement and improve the Prairie Law,Property Law and the relevant legal systems in Gansu Province,promote the transformation of herders' management methods,develop scale operations.Multiple measures were taken to promote the circulation of the right to contracted grassland management,establish a system of security deposits for commercial and industrial enterprises to lease grasslands,and explore the establishment of a legal system for removing grassland circulation in Gansu Province.Improve the legal mechanism for grassland protection compensation and balance the conflicts between grassland ecological protection and pastoralist livelihood.Strengthen the protection of the right to contracted management of households in grasslands and improve the procedures for determining membership in collective economic organizations,accelerate the issuance of certificates for the contracted management of grasslands,implement the latest provisions of the Rural Land Contract Law.
