Research On The Legal Countermeasures Of Sexual Harassment Prevention And Treatment

“ Sexual harassment ” has not been a new topic in our country.With the continuous progress of society,while people's material life has been improved,they have also made significant progress at the ideological level.Attitudes toward “sex”also tend to be objective gradually,and the awareness of rights protection has been gradually enhanced.However,due to the particularity of the “sex”,all works of life have avoided this issue to varying degrees.Because China's law starts late,the legal regulations on sexual harassment are not sound,and the governance of sexual harassment has not been paid much attention before,which leads to the backwardness in the governance of sexual harassment compared with developed countries?regions?.Beginning with the basic concept of sexual harassment,this paper analyzes the current situation of legislation from the central government to local government,and hidden problems found by the judgment of cases in practice,including the imperfect provisions of sexual harassment in the law,the weak operability and other problems.Through understanding the mature laws and regulations of sexual harassment in foreign countries,we can learn from them the relevant provisions that are suitable for China's national conditions,and analyze the causes of sexual harassment from different perspectives such as society,culture,law and so on.Finally from the perspectives of legislation,justice,and law-abiding,the author puts forward the relatively appropriate legal countermeasures.The whole article focus on sexual harassment,with the purpose of improving the legal countermeasures of sexual harassment,in order to find the effective regulatory measures to control sexual harassment,at the same time improve the legal system of our country,promote the progress of rule of law in China.
