The Study On The Perfection Of Juvenile Judicial Education System In China From The Perspective Of Welfare

Juvenile justice is a system of juvenile law and social welfare.As an important part of juvenile justice,juvenile justice education aims to prevent juveniles from going astray and make them return to society better.This paper discusses the perfection of juvenile judicial education system in China from the perspective of welfarism.The first part demonstrates the rationality and feasibility of the welfare concept in perfecting the juvenile judicial education system in China from the three aspects of the connotation,structure and concept of the juvenile judicial education system of welfare.The second part takes the realistic dilemma of China’s juvenile judicial education system as the entry point,analyzes the existing problems at the legal level,the organizational level and the social level,and explores the causes of the realistic dilemma,that is,the lag of the value pursuit and the concept of welfare.The third part introduces the characteristics and characteristics of juvenile justice education systems in the United States,Germany and Japan.On the basis of understanding the monorail model of judicial welfare in the United States,the dual track model of judicial welfare in Germany and the eclectic model of judicial welfare in Japan,it draws on relevant experience that can be used for reference.The fourth part discusses the perfection of juvenile judicial education system in China.First,the foundation of perfecting this system is to grasp its principle accurately.Secondly,we should consider how to promote the welfare of juvenile judicial education system in China from the perspective of legislation and practice,judicial system and social resources.Juvenile judicial education system in China should pay close attention to the education of the underage criminal correction,the shift to a higher level of welfare education,not only consider implementing to the basic goal of juvenile offenders reintegration,and should consider how to promote the healthy growth of juvenile,encourage bad behavior juvenile and the minor offenders return society with better attitude.
