Study On The Right Relief Mechanism Of Children Abused By Family Members In China

Human rights are the inherent rights of everyone.As the wealth of the country and the hope of mankind,children's rights,as a vital part of human rights,deserve special attention from the law.Therefore,protecting children's rights and establishing a relief mechanism for abused children's rights are important measures to protect children's rights and promote children's healthy growth.However,in view of the current legal system and theoretical research in China,the research and relief measures of children's rights are not comprehensive,and the operation of legal relief after children are abused lacks a clear legal application.There is a serious absence of law in certain links,and the existing legal relief system is weak in practicality and cannot meet the social requirements for children.This article is based on reading the historical documents and legal provisions in and outside territory,drawing on the advanced theoretical knowledge and practical experience from extraterritorial countries or areas,and then conducting research from the following four aspects:The first part specifically discusses the relevant provisions of our country on the relief of abused children's rights and some relevant cases.Firstly,it analyzes the representative and highly concerned cases of child abuse in China in recent years;secondly,it discusses the definition of the concept of child abuse;thirdly,it clarifies the necessity of the right relief of abused children in China.The second part specifically discusses the current situation and deficiency of China's relief mechanism of abused children.First of all,the rights relief mechanism needs to be sorted out.Then,there are many deficiencies in the relief mechanism of abused children in China,including the definition of child abuse is unclear,the current reporting system is not perfect,some definitions are vague,and lack of enforcement procedure.The third part specifically discusses the international efforts on child abuse relief mechanism.First,it outlines the protection of the rights of abused children in public international law.Second,it discusses some developed countries' excellent experience in the establishment of the mechanism for the relief of abused children's rights.The fourth part specifically discusses the improvement of relief mechanism of abused children' rights in China.First of all,it is necessary to clarify the improvement of the relief mechanism at the level of the legal system,and to make suggestions on the improvement of the system from the legislative,judicial,and administrative aspects;second,to propose ideas for the establishment of relevant organizations.Finally,the influence of media for the promotion of relief measures is enormous,hoping to increase people's awareness of helping those abused children by that.
