As a serious crime of violating human rights,human trafficking has not disappeared with the progress of human civilization,but has become a high profit crime.The huge profits brought by human trafficking make this criminal activity not only banned repeatedly,but also spread to every part of the world.Studies published by the United Nations Office on drugs and crime show a steady increase in the number of victims of trafficking worldwide.In 2019,the case of "death truck" in the UK once became the focus of the world.Illegal immigration and human trafficking caused widespread concern.The protection of victims' rights is still an urgent problem in the field of anti human trafficking.The international community has made unremitting efforts to fight against human trafficking.The protocol to prevent,suppress and Punish Trafficking in persons,especially women and children,supplementing the United Nations Convention against Transnational Organized Crime(the United Nations Protocol against human trafficking,hereinafter referred to as the protocol),as the most important international treaty to fight against human trafficking in the world,develops in the field of combating human trafficking and protecting victims It plays an important role,but the protocol itself also has some shortcomings,mainly manifested in the utilitarian protection of the rights of victims,the relevant provisions only stay in the scope of the recommendations,the safeguards are not complete,etc.,which makes the rights stipulated in the protocol not well implemented,and some systems instead become some states parties to fight against illegal immigration Tools seriously damage the rights of victims.In the process of improving the protocol,first of all,we need to analyze the contents and problems of the protocol,combine with the provisions of other international law documents and the effective practices of relevant countries,and put forward solutions to improve the protection of victims' rights.From the perspective of the purpose of the treaty,we should emphasize the importance of protecting human rights,so as to change our previous views on the criminal justice framework of the protocol;from the perspective of the subject of implementation of the treaty,we should emphasize the national responsibility of the state in protecting the rights of victims;from the perspective of the content of the treaty,we should focus on the protection of the rights of victims,and constantly explore the possibility of comprehensive protection of thehuman rights of victims The way of profit.So as to ensure that the legitimate rights of victims are protected and make the provisions of the protocol more scientific and effective.In addition to the analysis of the contents of the protocol,China's responsibilities under the protocol are also of research significance.As a country of origin and destination of victims of trafficking in human beings,since China joined the protocol,China has actively fulfilled its obligations by amending legislation and formulating relevant policies,etc.,and has made achievements in the protection of victims' rights Some results have been achieved.However,it is undeniable that there are still defects in the practice of protecting the rights of victims in China,and the relevant protection work needs to be further implemented.
