On The Causes Of The Crimes Committed By Discipline Inspection And Supervision Cadres In China

On November 8,2012,the 18 th National Congress of the Communist Party of China was ceremoniously held in Beijing.This conference opened the curtain of the large-scale anti-corruption of the Communist Party of China.Many high-ranking officials did not expect that this anti-corruption campaign was so powerful,which can be described as shocking.The Central Committee of the Communist Party of China has made up its mind to fight against corruption.Its determination has not changed,and its strength has been increasing.As long as it violates Party discipline and national laws,no matter who he is or how high his position is,he will be severely punished.Many officials have been transferred to justice for serious violations of disciplines and laws,from "big tigers" at the provincial,ministerial and even national levels to "flies" at the city,county and even department levels.At the same time,with the continuous reports of these "tigers" and "flies" in the media,people pay more attention to the anti-corruption situation,in which the phenomenon of Party members and cadres involved in job-related crimes due to corruption has become extremely prominent.Some major cases have been ruled: the senior leading cadres such as Bo Xilai and Liu Zhijun have been investigated for criminal responsibility according to law,and Zhou Yongkang,a former member of the Standing Committee of the Communist Party of China,has also been put on file for examination and investigation.After the18 th National Congress of the Communist Party of China,one after another senior cadres and public officials were sent to the trial seat for duty crimes.The number and frequency of officials,the level of officials involved and the number of cases are unprecedented.However,in this anti-corruption torrent,there are some problems that are also thought-provoking.In so many cases investigated,there are such a kind of people,who should have been the "killers" of job-related crimes that make many corrupt officials panic at the news,but eventually they mingled with them and went to the abyss of crime.Compared with other cases of violating disciplines and laws,the negative effects caused by the cases of duty crimes of discipline inspection and supervision cadres are far worse and far-reaching than those caused by ordinary crimes,especially the exposure of many duty crimes of the cadres of the Commissionfor Discipline Inspection and supervision shames the discipline inspection and supervision cadres.As the party's organ specialized in performing the supervision function and the organ specialized in performing the state supervision function,the Discipline Inspection Committee and the supervision committee each play an important role in the supervision of the party and the state,and have an important position and high power.Therefore,this means that the quality of discipline inspection and supervision cadres,whether they are honest or not,and whether they can strictly abide by Party discipline,party rules and national laws and regulations are bound to be related to the success of the anti-corruption struggle,even the survival of the party and the rise and fall of the country.In this context,it is urgent and significant to investigate the actual situation of the crime committed by discipline inspection and supervision cadres.This article starts with the cases of the cadre's duty crime in the discipline inspection and Supervision Commission,summarizes and refines the main characteristics of the discipline inspection and supervision cadre's duty crime,analyzes the causes of the discipline inspection and supervision cadre's duty crime in combination with practical work and practical cases,so as to investigate and discuss the methods and suggestions for the prevention and treatment of the discipline inspection and supervision cadre's duty crime.Through the problems reflected on the surface of the case,we can find out the real reasons behind the appearance,grasp the essence of the problem in essence,and provide guidance and reference for the prevention and treatment of the post crime of discipline inspection and supervision cadres in the future.This thesis is divided into four parts.The first chapter defines the concept of post crime of discipline inspection and supervision cadres in China.The second chapter gives an example and a brief description of the cases that have been and can be made public to a certain extent,and summarizes several types and outstanding professional characteristics of the crimes.In the third chapter,based on the actual work and the relevant cases as the main analysis basis,based on the consideration of the published cases of the post crime of discipline inspection and supervision cadres,including the cases under investigation and the cases that have been adjudicated,the author makes repeated comparative analysis to think about what causes so many discipline inspection and supervision cadres to embark on the road of the post crime.The fourth chapter puts forward the prevention and control path of professional crime of discipline inspection and supervision Cadres: first,pay attention to integrity education,improve the ideological awareness of prevention of professional crime;second,increase the intensity of punishment,cultivate positive psychology;third,speed up the prevention legislation of professional crime,standardize the responsibility of prevention subjects;fourth,improve internal and external supervision;fifth,establish and improve relevant legislation and measures.
