Study On The Protection System Of Collective Land Resources In China

All things are born in the earth,and the earth is the mother of all things.Land resources bear the survival and development of human beings and provide the basis for the continuation of human civilization.Land is not only the precious wealth of the country and people,but also the foundation of China's economic development.With the rapid development of China's economy and the advancement of urbanization,the demand for land resources is increasing.The shortage of state-owned land resources makes the demand for land resources gradually shift to collective land resources,and the pressure on collective land resources is also increasing.Collective land is a kind of basic and strategic resources,which combines the attributes of resources and property rights.We should protect the collective land while using it.The imperfect protection system of collective land resources in China leads to the serious destruction of collective land resources,the gradual decline of the quality and quantity of collective land,which affects the economic development and food security in China.From the perspective of protecting collective land resources,this paper is divided into five parts.The first part mainly introduces the background,significance,main ideas and methods of this paper.The second part mainly discusses the property right attribute and resource attribute of collective land,as well as the analysis of the relationship between them.The third part mainly analyzes the current situation of collective land resources in China,and draws the conclusion that the total amount of collective land resources in China is decreasing sharply,the quality is declining,and the land pressure is increasing day by day,and then leads to the necessity of protecting the collective land resources in China.The fourth part mainly discusses the problems existing in the protection system of collective land resources in China,including the backward legislation of collective land resources protection,the lack of self-protection of the subject of collective land ownership,the narrow scope of the control system of collective land use,the unscientific compensation system of cultivated land,the lack of the legal system of land quality protection,the incompleteness of the relevant legal liability system,and the supervision of land resources protection Discussion on the deficiency of management.The fifth part is mainly to put forward suggestions for the existing legal system of collective land resource protection in China,strengthen the legislation of collective land resource protection,improve the kinetic energy of collective land self-protection,broaden the scope of collective land use control,promote the scientific operation of farmland compensation system,build the legal system of land quality protection,improve the responsibility system of collective land protection,and improve the land supervision system Through the perfect legal system,scientific and reasonable system to protect our collective land resources.
