Research On The System Of Ascertaining The Responsibility For The Police Law Enforcement Faults

In January 2016,the Ministry of Public Security issued the revised Regulations on Ascertaining the Responsibility of Law Enforcement faults of the police officers of the Public Security Organs(hereinafter referred to as the “Provisions”).which is a system of finding and correcting law enforcement faults through the internal supervision of public security organs to punish and warn those officers.The revision and improvement of this system is carried out under the background of the CPC central committee accelerating the promotion of the comprehensive rule of law in China,and it is also a concrete implementation of the policy of administering the police in accordance with the law strictly.In the process of implementing the system of ascertaining the fault responsibility of the police in law enforcement,the public security organs have a number of internal departments to participate in the process,such as personnel,discipline inspection,supervision,legal,auditing,complaint reporting and law enforcement departments.They need to cooperate with each other to jointly complete the investigation and identification of the fault of the police in law enforcement.There is no detailed explanation on the decision-making subject and working procedure of accountability in the provisions,so it is necessary to issue detailed implementation rules and improve them in the implementation process.At the same time,this system also encountered some management difficulties in practice.This article puts forward some countermeasures to improve the management of law enforcement fault accountability in the light of the problems in the implementation,such as the unknown decision-making subject,the unclear division of the enforcement subject,the responsibility conflict of "sportsman and referee",the vague definition of law enforcement responsibility,and the working process to be clarified.The basic context of this research includes: concept analysis,system evolution,system implementation status analysis,management problem analysis,and management countermeasures.The study takes management control theory and public security internal supervision theory as the theoretical basis,and uses literature analysis,practice summary and other methods to analyze the implementation practice of the police law enforcement fault accountability system from the perspective of management improvement,and proposes the concrete management measures for the improvement of the system according to the questions of” who ascertain”,” ascertain whom” and ” how to ascertain”.
