On The Dispute Of Rural Land Right Confirmation

Since agriculture plays a prominent role in the development of Chinese economy and society,Chinese government must tackle“three rural issues”concerning agriculture,countryside,and farming population.These three rural issues converge on the use agrarian land.Therefore,it is crucial for the farming population to have a solid and lucid understanding of land ownership in the economy of socialism with Chinese characteristics.The consolidation of this understanding among Chinese farming population matters to the protection of their rights and interests of land,to dissipation of potential conflicts and disputes,and standardization of land make-over process.Seeking to tackle land issues in Chinese rural areas,the Ministry of Agriculture has issued a number of proclamations on agrarian land rights certification and registration.On the macro scale,this land right registration and certification will integrate the rural area's idle agrarian land resources,will build a land management with higher level of modernization and intensification,and will promote the organic development of the rural land make-over market.On the micro scale,the new policies will protect the land rights and interests of individual farmer.Nonetheless,land conflicts and disputes are still inevitable in the process of land right determination because of the intricate the relationship among various parties is complicated.The recent round of land right determination has exposed the previously overlooked problems in our land policy.This thesis investigates what the factors lead to the challenges in local governments face and offers constructive suggestions by examining a few specific cases of land right determination.The thesis consists of six parts.The introduction lays out the background of thisthesis and offers a literature review,and articulate the scholarly lacunae that thesis strives to fill.The second part elaborates the critical theoretical framework that shapes the research and argumentation of this project.The third part articulates the significance of land determination,elucidates the implication of the reform of rural land property rights system.The fourth part uses a case of Y city in Jiangsu province to analyze the basic practice,progress and problems in the local-level policymaking.Meanwhile,this part identifies three categories of the disputes encountered in the process of land right determination in Y City: disputes between farming households,disputes between farming households and collectives,and disputes between farming households and industries.The fifth part analyzes the explicit and implicit factors of land disputes.The sixth part offers suggestions for guiding the appropriate scale of land management,improving the relevant system of land right determination,establishing the mediation mechanism of land disputes,improving the arbitration system of land disputes,and building the prevention mechanism of land disputes.In conclusion,this thesis argues that there is still a long way to go to fully tackle resolution of land conflicts and disputes.To better protect the land rights and interests of the farming population and reduce land dispute in rural China,the governments,the farmers,and the academics must keep working on the innovative approaches to this socio-economic issue and the superstructure of Chinese agricultural policy,so as to contain the growing number of land disputes.
