Economic globalization has become the mainstream of the development of the times.The advent of the era of big data has made cross-border e-commerce the current major consumption model.Because of the transnational,instant electronic,and anonymity features of cross-border e-commerce,while bringing shopping convenience to consumers,it has also brought many problems to the protection of consumers' rights and interests.An important part of this is Protection of personal information under consumer privacy.Due to the unique business model of cross-border e-commerce,the role of cross-border e-commerce platforms has been significantly enhanced in the entire cross-border transaction.Illegal and unreasonable collection and use of consumer personal information,including consumption records,occurs from time to time.Even consumer information collected using compliance methods does not protect consumers 'privacy.In the United States and the European Union,consumer privacy has been legislated since the 1950 s.The United States and the European Union have adopted different protection models.The United States has expanded the scope of interpretation of privacy.As early as the 1970 s,the United States issued the first federal constitution that comprehensively protects the privacy of citizens,the ‘Privacy Act'.Law is the most important law in the United States to protect personal information.The subsequent enactment of the ‘Electronic Communications Privacy Law'also better adapted to the trend of the electronics industry at that time and expanded the scope of protection of citizens' privacy.The Consumer Privacy Act,announced in February 2015,illustrates the government's emphasis on consumer privacy.In addition,the United States still attaches great importance to industry autonomy,and it comes from legal management through the establishment of rules and regulations by industry associations.It has achieved good protection in combination with federal legislation.Unlike the United States,the European Union adopts a comprehensive legislative protection model for citizens' personal information.It also pays more attention to the protection of consumer personal information while expanding international trade.The introduction of the General Data Protection Regulation in 2018 has further expanded citizens' information control rights.The privacy shield model represents the EU's adherence to the freedom and openness of the market.Put it first,but it is also imperative to protect consumers' privacy rights.China and the European Union have basically the same attitude on crossborder e-commerce issues.Therefore,the EU's series of legislation is worth studying by China.At present,China's current legislative system does not systematically protect the privacy rights of consumers in the cross-border e-commerce environment.In the era of big data in which information is inflated,if the violation of consumer privacy cannot be effectively controlled,it will further affect other legitimate rights and interests of consumers,and cross-border e-commerce cannot continue to flourish.Therefore,how to make a trade-off between the rapid development of cross-border e-commerce and the protection of consumer privacy rights,while maintaining the bottom line of consumer privacy protection,it has become more urgent.The purpose of this article is to sort out the meaning of traditional privacy rights and the characteristics of consumer privacy in the special context of cross-border ecommerce,and to explain the relationship between consumer privacy and personal information as necessary.By sorting out relevant laws,regulations and policies on protecting consumer privacy in cross-border e-commerce between the United States,the European Union and international regional organizations,learning from their mature experience,sorting out the current status of legislative protection in China,and discovering problems,then proposed to improve Recommendations on consumer privacy protection in cross-border e-commerce.
