The Change And Improvement Of The Legal System Of The Endowment Insurance In China

The aging problem brings impact in China,in order to stand up to the challenges that China ranks the fifth in the most serious global aging risk countries.The pension problem is particularly prominent among them.We need a sound and perfect law setup to ensure endowment insurance system reasonable and effective.Although there is abundant theoretical macro analysis and research in Economics and Sociology,there are few researches on the legal system of pension insurance from the perspective of law.Therefore it hinders to carry out the law and solve the national endowment problem.This paper intends to study the law system of endowment insurance in our country by using the new institutional economics and legal theory.Firstly,the paper analyzed the different social background of endowment insurance legal system,and the change process of the different system about each insurance group,in each historical stages since the new China built up;secondly,this paper makes a reflection on the theoretical root and a summary of the law on the changes of the legal system in a dynamic perspective,and from the macroscopic perspective;thirdly,the paper analyzed the current social background,and found that it is urgent and inevitable to reform the endowment insurance system;finally,based on past experience and historical lessons the current reform background,in face of the specific problems in reality,combined with previous experience and historical lessons,the paper made plans for the development and perfection of the legal system of endowment insurance in our country in the years to come,so as to better change the challenges of aging problems into the opportunity in our country.
