Comparison Of Juvenile Delinquents Social Investigation System Between China And Japan And Our Enlightenment

Young people are the hope of prosperity in every country,and China has a large number of minors.Because of their unique physical and mental characteristics,young people need special treatment from the state society.Especially for juvenile criminal offences,judicial procedures and special cases should be given to adults.Based on this,it is urgent to improve the juvenile justice system in our country.And the social investigation system is an important part of improving the juvenile justice system.It is the premise of punishment for juvenile related cases,provides a reference for objective and impartial evaluation of minors and their behavior,and to a certain extent,promotes the process of judicial reform,and really implements the concept of education,correction and protection for juveniles.Japan's juvenile justice system has been more than 100 years of history,has experienced three major changes,drawing on the juvenile justice system and its European conditions to fusion,formed a distinctive feature of the juvenile justice system and social survey system which is part of the most distinctive.Japan will be involved in the juvenile justice system of juvenile delinquents are collectively referred to as "juvenile delinquent".It is divided into three categories: juvenile delinquents,juvenile delinquents and juvenile delinquents.Because of the juvenile delinquents include not only include the penalty punishment but not to violate the standard of youth,so requirements of social investigation system must conform to the principle of comprehensive investigation,the principle of confidentiality and investigating preposition doctrine.At the same time carries on the investigation to the juvenile delinquents by full-time investigators,and issued a survey report.There are different degrees of these inspired system on China's social survey system development,through the comparison on the system in our country,to clarify the social investigation system after the problems in legislation and practice feasibility and put forward some countermeasures,hoping to promote the development of the system of social investigation in china.This paper consists of four parts,mainly using the literature analysis method,comparative study method and method of combining theory and practice,through the comparison on the social survey system experience,analysis of the existing social investigation system of current domestic problems,to further improve the social survey system for implementation of the scheme.The first part is "the summary of the juvenile justice system between China and Japan".This paper mainly summarizes the differences of the juvenile justice system between China and Japan and the importance of understanding the social investigation system under the background of different judicial systems.The second part is the related concept of juvenile delinquents social investigation system,mainly introduces the concept of "juvenile delinquents" and "social investigation system",with the subject of social investigation system from the basic concept of object interpretation.The third part is the "compare social investigation system of juvenile delinquents between China and japan".This part is the focus,mainly from the two levels of entities and procedures,to analyze and compare the differences between China and Japan's social investigation system.This chapter summarizes the characteristics of the social survey system in Japan and China through comparing the subjects,comparing the contents,and comparing the procedures,so as to provide reference for our social investigation system.The fourth part is "the problem of the social investigation system in our country and the enlightenment".Through the analysis of the previous part,the problems existing in the social investigation system in China are summarized,and there are realistic difficulties on the subjects and the nature of the social survey report.Aiming at the predicament of the social investigation system in China,proceeding from the actual situation,this paper puts forward some suggestions for improvement from two aspects: legislation and practice feasibility,and focuses on the construction of the social investigation mechanism.
