Since the 1960s and 1970s,with the changes in women's roles in social production,economic life,and workplace functions at both international and domestic levels,'woman' is not the person who should stay at home and take care of husband and kids anymore.Female takes more and more weight in the workplace and gets more equal rights compared with male in the workplace.In addition,people gradually realize that male,as husbands and fathers,play an irreplaceable role and responsibility in caring for their wives and raising kids in their family life.As a result,the women's liberation movements in western countries have been rising.Sweden was forced by public pressure to establish the system of birth paternity for newborn fathers in 1974.This is the first time in human history to recognize fathers' obligation in the form of laws and regulations.Therefore,the original concept of the male paternity leave system was born.Male paternity leave refers to the period during which the male employee temporarily returns to his family during wife's childbirth.In this time,male employee as a husband and father are required to accompany the wife,and meanwhile,take care of the infants.Looking at China's domestic situation,the paternity leave system has not yet formed a unified national law.There are only local regulations existing in different cities.However,the length of leaving period varies among different places.For example,the shortest paternity leave is a three-day leave in Shanghai,and it extends to thirty days in Henan province.Besides the above gaps,the scope of applicable subjects for male paternity leave is narrow.Couples who are eligible for late marriage or childbearing,or couples who come from one-child families can enjoy rights.Moreover,the current incomplete male paternity leave lacks thorough facilities as well as provisions on maternity benefits.Although the public has an understanding of the content of paternity leave,the overall social attention to such system is still in a lower level.Furthermore,male employees are not aware of their own rights.As a result,employers have the legal vacancy to evade responsibility.Male employees have no places to claim their right on paternity leave.These problems have hindered the development of the male paternity leave system in China,which is not conducive to the maintenance of male reproductive rights and social harmony as well.By analyzing the origin,causes and legal attributes of the paternity leave system,this paper studies the domestic status of the male paternity leave system in China and finds out the specific reasons and problems that hinder the development of the system.In addition,learning from the foreign experience of related birth system,this paper provides feasibility and operability in the operation of the design and development of this system in China.in response of the specific problems in our country,there are reasonable suggestions for the improvement of the male paternity leave system.First,improving the legal status of the paternity leave system and related regulations.Second,expanding the scope of application of the male paternity leave system.Third,improving the male paternity insurance and welfare treatment.Fourth,completing the related support for male reproductive rights.Fifth,increasing publicity and education to give play to the leading role of the government.Finally,enhancing the awareness of individual rights protection and making the departments for safeguarding rights clearly.
