The Perfection Of Flexible Working Hours System In China

At the end of the 20th century,in order to adapt to the rapid economic development in the reform and opening up and the establishment of a large number of foreign-funded enterprises,China's labor law introduced two working hours systems:"untimed working hours" and "comprehensive working hours" Because these two working hours systems have broken the standard working hour system's "9-to-5"mode of work,which gives enterprises a certain flexibility in arranging staff work,it is regarded as the beginning of the implementation of flexible working hours system in China.With the optimization and upgrading of industrial structure and the great improvement of people's material level,the traditional standard working hour system and the only two flexible working hours systems can not meet the development needs of emerging industries,and it is difficult for current workers to balance family and work.The contradiction between them?so both enterprises and laborers are demanding reform of the current working hours system to make them more flexible.On the one hand,laborers have a strong demand for "flexible working hours".On the other hand,China's legislation in related areas lags behind the current state of social development and has led to numerous labor disputes.Through comparative analysis and literature analysis methods,this paper draws on the legislative experience of the "flexible working time system" in developed countries and Taiwan,and analyzes the shortcomings of the current flexible working hours system in China,which is better for China's economic development.Provide advice and reference to the working hours system that respects and protects the interests of workers.With the theme of perfecting China's flexible working hours system,this paper is divided into five parts.The first part is an overview of the flexible working hour system,which explains the definition of the flexible working hour system,the specific form and scope of application.The second part introduces the current legal provisions of the flexible working hours system in China;the third part analyzes and enumerates the flexible working hours system in China.Insufficient;the fourth part introduces the flexible working hours system in Germany,Japan and Taiwan;the fifth part is the proposal for improving the flexible working hours system in China.
