The standard system of working hours is an important factor affecting labor relations.The reasonable standard system of working hours can not only protect the rights and interests of workers but also enhance the vitality of enterprises.Working time standard suitable for the development of The Times should be the common value goal of both labor and capital.China's current working hour benchmark system was formed in the mid-1990 s and has been in operation for 20 years without any modification,which seriously disconnects with working hour practice.The frequent violations of the working hour system by employing units result in the severe compression of the free time of laborers,and the rest right of laborers cannot be effectively guaranteed under the current working hour standard legal system,and even the phenomenon of "karoshi" occurs.To some extent,this will affect the harmony and stability of labor relations.To investigate the operation status of the working hour benchmark system in practice,the Internet era poses the following challenges to the traditional working hour system: first,the flexible employment relationship impinges on the existing subordination theory of labor relations,and the flexible employment model of the Internet industry impinges on the traditional labor relations;Second,the flexibility of working hours challenges the standard working hours system.The Internet industry that flexibly arranges working hours and implements flexible working hours often blurs the time boundary between work and life,and the implicit extension of working hours infringes workers' right to rest.Thirdly,the ambiguity of working time identification affects the fact identification,and the labor dispute over overtime pay is prominent in the Internet industry.In order to effectively solve the dilemma of the working hour benchmark system in the Internet era,it is necessary to reconstruct the working hour benchmark system in the Internet era and put forward some countermeasures to the existing problems of the working hour benchmark system by combining the theory of contract freedom,the theory of interest balance and the theory of labor relationship consideration.From the aspects of establishing the concept of labor relationship consideration,perfecting the standard system of working hour standards and the supporting system of working hour standards,we should improve the current working hour standards system.
