With the improvement of China's economic strength and international status,higher education faces new opportunities and challenges.In order to improve the quality of higher education and strengthen the international competitiveness of Chinese universities,we must first standardize the management system of university teachers and optimize the structure and quality of university teachers.The most important thing is to grasp the teacher's “entry barrier”,that is,the teacher's appointment.Therefore,since the founding of New China,with the development of the times,the way in which university teachers are employed and related policy documents have been constantly changing.Since the promulgation of the "People's Republic of China Teacher Law" and the "People's Republic of China Higher Education Law" in the 20 th century,the teacher recruitment system has legal protection.Since the beginning of the 21 st century,the "Implementation Opinions on Deepening the Reform of the Personnel System in Colleges and Universities" issued by the State and the "Guiding Opinions on the Positioning of Colleges and Universities" have clearly stated that the teacher appointment system should be fully implemented.The expansion of university autonomy and the reform of the personnel system have promoted the transformation of the university teacher appointment system in China.However,the reform of the employment system for university teachers in China has encountered a lot of difficulties.There have been many problems in the implementation process.The employment system is in the form of unequal hiring,the employment subject is not equal,and the nature of the hiring contract is unclear.Therefore,the university teacher appointment system has always been a hot topic for scholars.Some scholars analyze the rationality of institutional reform from the perspective of institutional change.Some scholars explore the design and reform of the system from the perspective of economics.Some scholars examine the issue of current university teacher appointment system from a legal perspective.However,few scholars have analyzed and researched the current university teacher appointment system from the perspective of relationship contract.Now China is about to abolish the university teacher establishment.The university teachers will adopt the post appointment system.The teachers will sign an employment contract with the university to determine the equal contractual relationship between the school and the teacher.By combing the historical evolution of the university teacher appointment system,this paper concludes that the university teacher appointment system can be divided into three periods.The first period was from the Qing Dynasty to the founding of New China(1898-1949),the second period was from the establishment of New China to the early 1990s(1949-1990),and the third period was from the early 1990 s to the present,and then combined with the current university teacher employment contract,to analyze the problems and reasons of the university teacher appointment system in China.Then,from the perspective of relationship contract,this paper analyzes the contractual characteristics and contractual relationship between Chinese universities and teachers.Finally,combined with the principles and concepts of relational contract theory,the direction and countermeasures of the reform of the employment system of university teachers in China are pointed out.The structure of this paper is divided into four parts: The first chapter is the introduction,including the research background,research purpose and significance,research status and research methods.The second chapter mainly expounds the relationship contract theory,the contractual characteristics and contractual relationship between the university and the teacher,and the contractual attributes of the university teacher appointment system.The third chapter mainly expounds the historical evolution of the university teacher appointment system.The fourth chapter mainly introduces the problem of the appointment system of university teachers by combing the changes of the employment system with relevant text analysis and interview investigation.The fifth chapter is mainly to propose method countermeasures.Based on the theory and characteristics of relational contract theory,combined with the university teacher appointment system and the characteristics of universities and teachers,the author puts forward corresponding suggestions and countermeasures for the problems existing in the current university teacher employment system.
