Study On Peasant Behavior In Land Disputes Among Farmers

With the increase of urbanization construction,the state of agricultural inputs,the economic value of land,the original will begin to town of abandoned land of rural migrant workers return home,by the way of land circulation of verbal agreement contains ills began to emerge,which is associated with the number of rural land disputes increase year by year,has become the important factors that affect rural social stability.Based on the land arbitration cases of land disputes in S county,gansu province from 2015 to2018,and combined with field interview data,this paper discusses the behaviors between farmers before land disputes and during the process of land dispute settlement and the logic behind the behaviors.The research finds that,as far as the subject is concerned,the land disputes between farmers have become the main source of rural land disputes,and the farmers' transfer behaviors before land disputes and the behaviors in land dispute settlement are both instrumental rational action types and traditional action types,which are not only economic relations but also social relations.Before the occurrence of land disputes,farmers have the safety logic mainly directed at avoiding risks."oral agreement" seems to be an irrational behavior with the risk of breaking faith,but actually contains the rational component that farmers avoid risks based on safety logic."written agreement" is becoming a new choice for farmers based on safety logic.After the land dispute,there are two kinds of profit logic based on local customs and legal provisions.The firsttwo are behaviors based on rural logic.The latter is the passive choice of farmers after their behaviors based on rural logic become invalid,and they follow the logic of jurisprudence.It also points out that the rural logic and legal logic will exist and compete in the rural field for a long time,until the rural nature fades and the legal rules are deeply rooted in the hearts of the people.The multiple settlement of rural land disputes should return to the village field,base on the village resources,and construct the road of the integration of legal theory and rural land development.
