In recent years,match fixing scandals in international sporting events have drawn much attention.After a long-term controversy,the international community generally recognized it as an international crime.At present,the new urgent problem needing to be solved is to determine the legal basis for regulating the act.The UN,Interpol,the International Olympic Committee and other international organizations explain the problem in a fragmented and unsystematic way,which is difficult to be targeted.According to the analysis of practice and the authoritative interpretation of international organizations,the legal basis for regulating this act can be divided into two levels: international and domestic.There are three main types of legal bases at the international level: International treaties against corruption and international treaties against transnational crimes,and international treaties specifically designed to combat match-fixing,as well as international sports organization constitution,the discipline standard which are qualified as the international sports soft law.Among them,anti-corruption-related international treaties and international treaties specifically designed to combat match-fixing are not directly applicable to specific actors.Domestic laws are improved because they need to in accordance with the content of the treaties as states members.Constitutions of international sports organization and the discipline norm are recognized as the internationalsports soft law.Although may act as the legal basis to carry on the punishment directly to the perpetrator,its application subject is limited in the athletic field.They cannot regulate the transnational crime ring behind the scenes.In view of the limitations of the legal basis in the international law,the domestic legal basis is still needed to complement it in practice.The most universally applicable basis of domestic law in all countries is criminal law.In addition,some countries with developed sports industry set up relevant provisions in the sports law as a legal basis.In a very small number of countries,criminal and sports laws are the common legal basis because of the specificity of the domestic legal system.The complexity,concealment and transnational nature of match fixing in international sporting events make it more difficult for the public to investigate and punish it.It is difficult to achieve effective regulation by relying only on a certain level of legal basis.Therefore,it is necessary to strengthen the coordination between the international and domestic levels to form a systematic legal basis.
