Research On Market Supervision In The Background Of Commercial System Reform

Since the reform of the commercial system was fully started in 2014,the form of China's administrative license supervision has undergone a major transformation.It has changed from the former “strict into wide pipe”,which is mainly based on access verification,to the “Wide into bat” that focuses on follow-up supervision.The subject of administrative licensing exercised the authority to supervise and manage the holders of the administrative license after making the administrative licensing decision.The reform process has not been easy,some of the regulatory issues that appear to administrative supervision had negative impacts.Nowadays,there are mainly the following problems in market supervision: Firstly,the current laws and regulations are lagging behind,resulting in difficulties in the supervision of enterprise registration information.At the same time,due to the unclear scope and boundaries of supervision,the legal basis in the supervision process is insufficient.Secondly,long-term supervision mechanism has not yet formed.Administrative penalties based regulatory mechanisms into the regulatory credit-based regulatory mechanism to require collaboration among regulatory authorities in order to be realized,lack of inter-sectoral coordination mechanisms resulting in duplication of regulation,cross regulation and other issues.The information sharing mechanism has not yet been established,which affects the interaction and exchange of information between departments.Since the information cannot be shared,the credit supervision and punishment of the enterprise is not enough,resulting in inadequate credit supervision.Thirdly,the own dilemma of regulatory department.Law enforcement ranks behind,unable to cope with the sharp increase in market players;behind the lack of professionals and regulatory philosophy,the way to carry out the supervisory work brings difficulties.To solve the above problems,to be started from the laws and regulations applicable to the regulatory work,law enforcement and regulatory mechanisms,law enforcement ranks three levels.The general idea is: to provide procedures and regulations for administrative licensing and administrative supervision and the basis for law enforcement handling cases;to summarize and sort out issues in follow-up supervision of market entities from a legal perspective;to establish information sharing platforms,mechanisms,and enforcement mechanisms as an important means to solve the problem of market supervision;to strengthen the law enforcement team,through the system of training,hardware and software inputs and other means and methods to improve the overall quality of law enforcement teams.Specific measures include: First,improve the legal system.Improve access and supervision laws and regulations while clarifying the boundaries of regulation.Second,establish and improve the long-term regulatory mechanism.Establish a shared "big data" platform,strengthen exchanges between various regulatory agencies,and improve the synergies and cooperation mechanisms among various departments.Third,intensify the construction of law enforcement teams.Strengthen the construction of law enforcement teams through training,hardware and software inputs,improve the overall quality of the team,and at the same time,deepen the role of supervision and self-regulation of social organizations,compensate for the shortcomings of existing law enforcement teams through the purchase of social services,and improve the depth of daily supervision and professionalism.To protect the achievements made in the reform to ensure the realization of the objectives of the reform.
