Study On The Reform Of The Right To Use The Homestead In Remote Mountainous Areas

With the rapid development of urbanization in China,the irreversible urbanization of rural population is in progress.In addition,the population flow in the rural areas is also accompanied by the following:the peasants in the suburbs have taken the lead in entering the city,the peasants in the ordinary farming areas move to the suburbs,and the farmers in the mountain areas also go down in order to seek a better living environment.In this process of the gradual transfer of the population,the homestead of the downhill farmers,no matter the lease,has not yet found the potential "successor",the property value of the right to use the homestead can not be guaranteed.At the same time,it is difficult to make full use of the idle farmers' houses in the suburbs and the low mountain areas of the plain because of the transfer of the use of the homestead in the collective economic organization.In fact,the urbanization of the rural population shows the scene of cascade flow,that is,the remote mountainous area to the plain low land,the plain low land and the traditional agricultural area to the suburb,the suburb to the city.Therefore,the academic research and policy design should not only directly face the problem of public product service(including residential security),which is equal to the peasants and the citizens of the city,but also to study and face the most terminal situation in the process of the population cascade flow,especially the problem of their land and property value protection in these terminal population flows.In general,the homestead system reform is based on the market mechanism to solve the rural homestead right of use circulation,so as to better maintain the value of agricultural land assets,but can not "let go",the market mechanism and the role of the government is indispensable.This paper mainly adopts literature research method,questionnaire survey method and in-depth interview method.Based on the survey of the typical mountainous rural area of the Wufeng county of Hubei Province,this paper first investigates the use of the homestead and the farmers' desire for the transfer of the right to use the homestead by filling out the questionnaire,and then collects the typical cases of the transfer of the right to use the homestead in the mountainous rural areas by the depth interview method.The typical cases are analyzed,and various factors that impede the transfer of the right to use homestead in rural areas are found out.This paper makes a deep analysis of a series of problems,such as the lack of the "baton" of the farmers' homestead,the idle of a large number of homestead in the low mountain valley,the limited circulation range of the right to use homestead and the prevalence of the homestead underground transaction,and finds out the questions on the system level,and how to improve it through these problems.Suggestions on the transfer system of the right to use the rural homestead in China are put forward.
