| Ecology is prosperous while civilization is prosperous,and ecology declines while civilization declines.Faced with the dual structure that has existed in the field of environmental governance in China,the state has put forward the requirement of “strengthening the unity of the urban and rural environmental governance system”.It is required to coordinate urban environmental governance and rural environmental governance and implement the most stringent ecological environmental protection system.In view of this,this thesis analyzes the performance and causes of the dual structure in the field of environmental governance in China from the perspective of environmental law,and explores how to correct it and realize coordinating urban and rural environmental governance.The first part of the thesis expounds the reasons and significance of the topic selection,and sorts out the research status of environmental governance at home and abroad.At present,the research is mostly based on economics and management disciplines.From the perspective of environmental law,this thesis uses the method of literature research and comparative analysis and innovatively proposes the urban-rural intercommunication mechanism of environmental governance.The urban areas and rural areas need to communicate and cooperates with each other and we need to adhere to the concept overall governance.The second part introduces the reasons and performance of the urban-rural dual structure in the field of environmental governance in China,and puts forward the urban-rural intercommunication mechanism of environmental governance.There is an imbalance between urban environmental governance and rural environmental governance in environmental legislation,environmental governance funding,and the protection of residents’ rights.The reason for these imbalances is that the city-centered legislative model,the unbalanced distribution and the lack of substantial freedom of farmers.The mechanism requires us to respect the differences between the urban areas and the rural areas.Then they should communicate and cooperate with each other.Finally,we must adhere to the concept of overall governance thinking.Coordinating the urban environmental governance and the rural environmental governance is our goal,and the urban-rural intercommunication mechanism can be considered as a measure.The third part analyzes the theoretical cornerstone and realistic considerations of the urbanrural intercommunication mechanism.The theory of sustainable development,the cooperative discourse of environmental rights,the theory of symbiosis and the theory of environmental justice lay the theoretical foundation for the mechanism.The difference and integrity of the urban environmental governance and the rural environmental governance provide feasibility.The fifth part draws on the foreign experience of urban and rural environmental governance.Japan’s environmental protection investment and environmental education adhere to the concept of “equality”.The United States have taken a lot of measures to promote urban and rural environmental justice.These provide us with experience.The sixth part tries to construct the urban-rural intercommunication mechanism of environmental governance in China.First of all,we should adhere to the concept of differential governance.The rural environmental governance focuses on governance,and the urban focuses on good governance.Secondly,learning from the urban areas,the rural areas must improve environmental legislation,optimize the governance structure and protect the environmental rights of rural residents.Thirdly,establish a counter-feeding mechanism and an urban and rural ecological compensation system.Finally,we must stick to the concept of overall governance.We need strengthen the overall planning of environmental legislation,unify the enforcement and supervision mechanisms,establish a linkage system and a shared pattern of urban and rural environmental governance. |
