Research On The Construction Of Judicial Democratization Under The Guidance Of The Marxist Mass History Concept

The Marxism historical masses has always been the guiding ideology of the party,which gradually formed a complete theoretical system under the continuous enrichment and perfection of the collective wisdom of the central leadership of the five generations of the communist party of China.In addition,with the continuous development of The Times,the connotation of the historical view of the masses is gradually enriched,that is,only by adhering to the guidance of the marxist theory of historical thought and guaranteeing the fundamental interests of the people,can we truly carry out the construction of socialist rule of law with Chinese characteristics.At the same time,the judicial as to protect the fundamental interests of the people finally has been focused by a security,judicial reform because of its great influence naturally become the focus of the construction of the socialist rule of law.In addition,the supreme people's court also made clear in the third five-year reform outline(2009-2013)that judicial democratization should be achieved.Under this background,the people's jury system guided by the marxist view of history was born.The people's jury system is to have "reform" of the people's juror system is perfect,it inherited from the people's jury system of the original at the same time,adhere to and implement the marxist mass historical thoughts as the instruction,will further widen the masses to participate in the activities of the judicial channels,is the people generally,the beneficial attempt,in order to participate in judicial activities actively,but also the effective exploration of the judicial democratization road.This paper is divided into four parts.The first part is the analysis of the basic content of marxist historical view of the masses,so as to establish the theoretical source of this article.The second part analyzes the development and improvement of the historical view of marxism in China.It is pointed out that the principle of mass historical view is keeping pace with The Times and adapting to the needs of social development,which is of great significance to China's socialist modernization.The third part briefly described the judicial democratization,and proposed the implementation should pay attention to the precondition of judicial democratization,namely general,active,orderly participation.The fourth part is the focus and innovation of this paper.In this part,the author firstly analyzes the chronic diseases of the people's jury system and obtains the necessity of the people's jury system.Secondly,in response to the debate about the people's jury system in the theoretical circle,the feasibility of the people's jury system is obtained.Thirdly,according to the principle of mass historical theory,the author makes a reasonable interpretation of the concrete measures of the trial work of the people's jury system,and obtains the superiority of the people's jury system.Finally,according to the new situation and new problems exposed by the pilot,the corresponding solutions and reasonable Suggestions are given according to the principle of mass historical theory.
