The service system is the bridge between the parties in the civil lawsuit and the direct information communication between the parties and the court,and it is also the link directly connecting the lawsuits before and after.3Nowadays,as the network goes deep into all households,judicial activities also begin to integrate with the Internet.This article focuses on the integration of the service system with the Internet,that is,electronic service.Electronic service refers to the use of electronic documents stored on computer storage devices as a medium to generate,send,receive,and store judicial documents by electronic means,optical means,or similar means,including but not limited to electronic devices.Data exchange,email,telegram,fax or fax.4Electronic service was formally regulated by the Civil Procedure Law in 2012 and has been in operation for 6 years since the date of the regulation.The emergence of electronic service has saved time for the court's service service,saved the court's manpower,material and financial resources,and improved efficiency,and brought convenience to both the court and the parties.However,in practice,the author finds that there are still certain problems in the application of electronic service.In general,the applicable ratio of electronic service is still relatively low,and therefore it does not make full use of the high-efficiency advantages of electronic service.Therefore,this article investigates the electronic service of courts in order to explore the implementation of electronic service,and further find out the reasons why electronic service has not been widely used,and make corresponding recommendations.This article will discuss three aspects.The first chapter is the introduction.It mainly introduces the reasons for research,the selection of research destinations,and research methods.Therefore,it is introduced from the second chapter.The second chapter mainly introduces the practice of electronic service and the existing problems in the investigation.First of all,the author explained the overall application of electronic service,and found that the application of electronic service in practice is not many.After that,the author discusses the type of electronically delivered cases,the electronic service power,the electronic service methods,the electronic service procedures,the electronic service personnel,and the technology.The intention is to excavate the electronic service application rate from the actual situation and data.The reason is not high.The third chapter is about the investigation of the previous chapter and the existing problems,and has a specific analysis of the causes of the problems.Specifically,it analyzes the causes of the problem from the three levels of legislation,court management,and parties.First,the legal provisions are general,and there is no statement on the specific use of electronic service and related responsibility and relief.Second,the level of professionalism and technical equipment of the staff in court administration is not sufficient.Third,the parties evade litigation and do not cooperate with the court.The fourth chapter is to make targeted recommendations on the problems and causes of the previous chapter.First,make up for deficiencies in the legislation,and detail the provisions for the relevant procedures for electronic service.Secondly,it pays attention to the court's system management of electronic service,such as raising professional literacy,introducing other electronic technologies,and setting up exclusive court logos.Once again,the combination of big data to find the address of the parties to serve,and through the promotion and interpretation of the relevant issues of electronic service,in cooperation with other administrative agencies and the introduction of lawyers to participate,will help to expand the electronic service application rate.
