The Dilemma And Countermeasures Of My Country's Postal Administrative Law Enforcement

Nowadays,with the development of electronic commerce,China's express delivery business ranked the first place in the world for four consecutive years(from the year 2014 to2017),the express business swelled rapidly in a short period and it boosted the postal service industry.With the rapid growth of express business and expansion of market,improper and illegal behavior in this industry is also increasing and getting more and more covert,which put the postal administrative into a severe situation to enforce the law,with the problems and difficulties of slow process of law supporting construction,ambiguous division and great pressure of law enforcement,ready to be optimized regulatory system,and law enforcement ability does not adapt to the development of the industry.On the basis of deep analysis and reference of the current domestic and foreign research results,combines the actual situation,countermeasures and suggestions of 11 small aspects in three major aspects in allusion to the problems existing in the law enforcement of postal administration are put forward.First,clarify the limits of law enforcement: the first goal is to set up the concept of duty exemption and correct supervision,carry out administrative law enforcement effectively;the second goal is to define the limits of administrative law enforcement clearly in accordance with the principle that "cannot carry out the law enforcement without being authorized,legal duties must be carried out",make sure there is no absence,not offside of law enforcement.The third goal aims to carry out "double random administration,one open policy" law enforcement methods,make full use of high-tech means,such as data bank and cloud platform,and continuously innovate the way of supervision,and to solve the problem of "fewer people doing more things" effectively.The fourth goal aims to link administrative law enforcement and criminal justice effectively,punish law crimes,perfect administrative law enforcement,maintain the authority of law,and promote work efficiency.The first measure is to promote the reform of the postal supervision system,turn the dual-leadership into local leadership,and eliminate many unfavorable factors that restrict the administration of law enforcement.The second measure is to reform the management system of postal enterprises,put an end to the mixed operation,comprehensively realize the separation of businesses,and create favorable conditions for administrative law enforcement.The third measure is to speed up the reform of the licensing system for express delivery operations,change the prior licensing system into the post-record system,in order to stimulate market vitality,standardize business operation,alleviate the pressure of law enforcement,and promote the further development of law enforcement.Third,enhance the law enforcement capacity.Firstly,strengthen the training of law enforcement personnel,improve their theoretical level and practical working ability;Secondly,strengthen the application of science and technology;make full use of remote camera supervising function and law enforcement auxiliary role of various kinds of information system to improve the law enforcement efficiency;Thirdly,reinforce the summarizing and upgrading to reach the target that the law enforcement personnel may open the mind,broaden the view and enlarge the scope of thinking,therefore to improve their professionalism.Fourthly,strengthening the supervision of law enforcement to help promoting the law enforcement capacity.The orderly and efficient conduct of postal law enforcement is of great significance in ensuring the sustained,rapid and healthy development of the postal industry,the development service of industry,agriculture and service industries,as well as promoting the steady development of the national economy.
