An Investigation Report On The Implementation Of The "Postal Law" In Heilongjiang Province

" Postal Law of the People's Republic of China"(hereinafter referred to as " Postal Law")has given the postal administration corresponding administrative functions from the aspects of supervision system,examination and approval record,administrative punishment,etc.As a fundamental law of the postal industry,the provisions are universal,but the lines of the provisions are extensive and can no longer fully adapt to the actual development of the postal industry in Heilongjiang Province.Based on this consideration and demand,within the basic framework of the " Postal Law",Heilongjiang Province has enacted the " Regulations of Heilongjiang Province Post" twice,which has played a positive role in promoting the development of the postal industry and the healthy operation of the postal industry in Heilongjiang Province,but with the bottleneck of the development of postal enterprises in recent years,the emergence of the express delivery industry and the establishment of the city(prefecture)level postal management system,the existing laws and regulations of the postal industry have shown some inconformity.In connection with the actual development of postal industry in Heilongjiang Province,this paper analyzes the current situation of implementing " Postal Law" in Heilongjiang Province,systematically analyzes the advantages and disadvantages in its implementation,and expounds the specific causes of the problems and puts forward countermeasures based on the characteristics of local postal legislation in Heilongjiang Province and the author's experience in grassroots postal management in recent years.First,it is suggested to further revise the Postal Law from the national legislative level in the light of the future development trend of the postal industry and the lack of legislation.Secondly,it is suggested to improve the local postal legislation in Heilongjiang Province,adhere to the principle of scientific legislation,keep pace with the times and dare to innovate,and revise the Regulations of Heilongjiang Province onPost to make up for the deficiency of the upper law.At the same time,it puts forward specific suggestions from the aspects of the convergence of laws and regulations,the innovation of supervision methods,and the construction of county-level postal administrations.Finally,it discusses how to control the discretionary power in administrative acts,which is now attracting much attention.I hope that through the research and analysis of this article,it will provide a powerful reference for promoting the healthy development of local postal industry and the construction of national postal legal system.
