In recent years,patients 'independent decision-making power has received much attention.Especially when the relationship between doctors and patients is tense,the disputes between doctors and patients caused by the infringement of patients' independent decision-making power have increased day by day.This article takes the case of maternal jumping in yulin,Shaanxi province in August 2017 as an entry point,and puts forward three key issues: whether maternal patients have the right to decide whether Caesarean section,whether hospitals infringe on the patient's right to make decisions and whether hospitals take responsibility for maternal death.On the basis of legal analysis of the contents,attributes of rights and conditions for the exercise of the patient's independent decision power,the current legislation and medical practice in China are combined.The author points out the problems in the law of patients' independent decision power in China and puts forward the suggestions of amending the existing relevant laws and regulations,increasing legislation,and adopting the method of regulating patients' independent decision power in the civil code.Promote harmonious development of doctor-patient relationship. |
