The development of Internet technology has brought great changes to our daily life.Internet technology makes our life more convenient and also brings new challenges.Internet group polarization event is such a challenge.There is also a more familiar term for the online group polarization incident: cyber violence,which some scholars have called the tyranny of the majority.Under the existing legal system,the law focuses on the protection of citizens' real rights.In the aspect of network,there is a lack of certain laws to protect citizens' rights.Due to the complexity of the event,the number of participants is uncertain and the results are unclear,the legislation in related fields is difficult.To prevent network group polarization,there is still a long way to go.There is a certain gap in the current legal system in the field of cyber violence,which is not binding on the generation and development of cyber violence.In terms of the generation,development and control of cyber violence,the current legal system is mostly focused on legal principles and lacks specific legal rules.With the advent of Web2.0,the Internet platform has begun to show its stronger openness,sharing and centralization.The information on the Internet is no longer decided by Internet Co or Internet practitioners.Users' participation in information publishing has formed a new pattern of network information in the era of Web2.0.Under the new network information structure,online life is more closely related to offline life.Because the behavior habits of online and offline life are interacting with each other,we can find that the boundaries between online and offline are becoming blurred.The highly liberalized Internet pattern makes the virtual world no longer "virtual",but gradually becomes a part of daily life.Some phenomena in real life are uploaded to the network for Internet users to discuss and analyze;some bad comments or behaviors on the network also affect the real life and causing bad results."Virtual" is transformed into reality,so network behavior also needs to be bound and sanctioned by law.The emergence of network violence has brought an impact on the order of the network industry,making the network environment more chaotic and disorderly,which has brought negative impact on the development of the Internet industry.At the same time,Internet violence also has an impact on real life,disrupting not only the order of the Internet industry,but also social order.Cyber manhunt,as a form of network violence,is a serious invasion of privacy.As a result of human flesh search,Internet violence can be translated into offline physical violence as well as online infringement.This will seriously infringe upon the rights of citizens' personal dignity and even threaten their personal security.Through a comparative study of Internet violence at home and abroad,this paper compares and analyzes relevant laws at home and abroad from the beginning to the end,and explores the legal restraint methods of Internet violence.This paper explores the behavior patterns of netizens bystudying the phenomenon of internet violence.From the initial stage,we can understand the reasons for the formation of network violence,and restrict it in the aspects of law,network and social life.From the legislative,social and personal points of view,the aim of the corresponding solution is to protect the civil rights,maintain the social and network order and carry forward the legal spirit.Moreover,this paper analyzes the internal mechanism of cyber violence from the perspective of sociology,which is of great significance to avoid the occurrence of events,control the development of events,and weaken the impact of the events.It not only provides solutions for network violence,but also has reference value for the maintenance of network and social order.
