Criminal Laws And Regulations For Fraudulent Marriages

This article mainly studies the criminal law regulation of fraud in marriage.The first part of the article is the case introduction and legal analysis.With three typical cases,the author analyzes the behavior of long-term cohabitation fraud,bride price fraud,and the separation of property after marriage,and leads to the concept of fraud.The second part of the article is the legislative and judicial status of the fraudulent act of marriage,analyzes the legislative status of the fraudulent act of marriage,the judicial status of the fraudulent act of marriage and the existing problems of the criminal law regulation of the fraudulent act of marriage,mainly the lack of explicit legislation and the problem of proof.The third part of the article is about the criminal law regulation of the fraudulent act of marriage.Firstly,it analyzes the necessity of the criminal law regulation of the fraudulent act of marriage.The article puts forward the specific criminal law regulation of the fraud behavior including the construction idea of the criminal law regulation of the fraud behavior,the feasibility analysis of the regulation as the special case of the fraud crime,and the standard framework of the crime of fraud based on the fraud crime.This article tries to analyze the characteristics of the fraudulent behavior through the study of the fraudulent behavior,and provides some feasible legal suggestions for the perfection of the criminal law regulation of the fraudulent behavior.
