Research On The Legal Issues Related To Enterprises In Real Estate Development

In the realm of real estate development,due to the extensive existence of affiliation,the legal relationship between the construction project parties becomes more complex,and the types of litigation disputes also show diversification.In recent years,the number of litigation cases accepted by courts around the country due to construction projects linked to the rise of the trend year by year,the interests of different subjects are not consistent,the difference between different situations is more difficult,and the legal responsibilities between each other are not the same.This not only brings a certain degree of difficulty to the improvement of the relevant legal system,but also brings a certain degree of complexity to the judicial trial.Based on the trial case of Yichun Intermediate People's Court,this paper makes a thorough analysis of the affirmation of affiliated behavior,the validity of the contract and the legal liability of the construction project contract,hoping to provide some help for the improvement of the relevant legal system and the judicial work.This paper mainly analyzes the problems of real estate development,starting from the basic theory,studies the definition,characteristics and manifestations of real estate development attachment,and finds out the economic and legal reasons for the phenomenon of attachment.Through the Enlightenment of the relevant cases encountered in the actual work,the judicial dilemma caused by the real estate development affiliation is analyzed in detail to objectively evaluate the adverse impact of the real estate development affiliation on the society and the harm to the affiliated enterprises.And from the perspective of the validity and responsibility of the real estate development affiliation contract,the hot issues related to the real estate development affiliation in judicial practice are specifically studied.
