At present,the lack of legal system in the protection of labor rights during the internship period of college students in China leads to the vague definition of legal status of college students during the internship period,the unclear nature of legal behavior,and the difficulty in securing labor rights.Due to the lack of legal provisions on the protection of internship labor rights in China at this stage,and in addition,some employers do not treat intern students as employees,and only use intern students as cheap labor.As a result,many college students are discouraged from internships.Internship labor should be the necessary application and test process for applying the theoretical knowledge learned by college students during their studies to the social practice.However,due to the lack of the internship labor rights protection system,the internship labor road is difficult and difficult.This paper conducts a special investigation and study on the problem that labor rights are difficult to be guaranteed during the internship period.On this basis,this paper presents a typical case of infringement of the labor rights of college students,and analyzes the reasons for the formation of the problem.The author combines and draws on the relevant legislation and experience of Western developed countries on the protection of labor rights and interests during college students' internships,such as France,Germany,Japan,etc.,the identification of legal status during the internship period of college students,the legal nature of internship behavior,school-enterprise Specific legislative proposals were put forward on the issue of the legal liability of both parties,the payment of labor compensation during the internship,the establishment of the infringement compensation system,and other internship labor rights protection issues.In addition,the author has considered the implementation of the labor rights protection system during the internship period.For example,how to play the role of the current social unions such as trade unions,the Communist Youth League,the Women's Federation,the Students' Union and other social groups in internship labor rights protection,the author put forward his own views and ideas.The purpose of this paper is to explore how to construct a legal system for the protection of internship labor rights with Chinese characteristics,so as to relieve the worries of college students during the internship period,in order to pave the way for the smooth and steady entry of college students.
