Research On The Logic Of Choosing Ways To Protect The Rights Of Migrant Workers

The problem of migrant workers is a special problem with China's economic development and social transformation.Due to the modernization,the acceleration of urbanization and the transformation of rural production mode,a large number of rural surplus labor force has flooded into the cities,participating in urban construction and service work,and engaged in non-agricultural labor.Migrant workers have made great contributions to the modernization of our country.Enjoying the treatment of citizens is their rights and interests,but the change of living environment and working nature have not changed the identity of peasants.Due to the long-term existence of urban-rural dual structure,urban residents and rural residents have great differences in social rights.Migrant workers live and work in cities,but they cannot enjoy the same social rights as urban residents,resulting in the lack of rights of migrant workers.Due to the institutional discrimination against migrant workers and the limitations of the migrant workers themselves,some rights and interests are difficult to be included in the migrant workers' team.Migrant workers' rights and interests are infringed,and the legitimate rights and interests of migrant workers cannot be guaranteed effectively,which will cause widespread public opinion and government's high attention.Since the reform and opening up,most of the migrant workers' living problems have been solved continuously,but their rights are often violated.The activism of migrant workers is a social action.This paper argues that the rights of migrant workers is the process of the game between migrant workers and various social relations.First,due to the rapid development of urbanization and industrialization in China,access to cheap rural land has become the primary goal of urban expansion andindustrialization.Land expropriation deprives farmers of the most important production data,which in fact causes many farmers to lose their jobs,but the social security of land-lost farmers cannot keep up with them in time.Second,a large number of low-cost rural labor into cities and China light industry base,not only reduces the real wages of migrant workers,and are in a foreign land,no social resources of migrant workers in the process of negotiation and employers in a strong position.In addition,rural migrant workers have also increased their living costs and restricted their rights to protect their rights.On this basis,it is believed that migrant workers are in a vulnerable group in the process of social relations,and the actual process of safeguarding rights is lack of effective means,the channels are not free,and the cost is increased.This paper generalizes the literatures at home and abroad about the rights of migrant workers,summed up the rights of behavior classification,the legal status and rights protection countermeasures of several major research,found that less academic attention to the choice of migrant workers rights protection way logic.Full text on this basis,defines the relevant concepts of rural migrant workers' rights to analyze the two ways of migrant workers rights protection types,namely system inside and outside the system of rights protection way,expounds the advantages and disadvantages,inductive effect and system of migrant workers rights approach choices of internal and external factors,after discussed in detail,the choice of migrant workers rights protection way to have a more profound understanding.In this way,the author puts forward the dynamic process of the choice of rights of migrant workers.According to the advantages and disadvantages of existing rights protection way,the influence factors of migrant workers rights protection way choice and the dynamic process of choice,analysis is given in the system of migrant workers from outside the system of rights to rights needs to be done by the effort: optimization of public power relief systems and mechanisms,improve the social relief rights utility,help migrant workers set up scientific and right consciousness,in order to better safeguard the rights and legitimate rights and interests of migrant workers,to maintain social harmony and stability.
