The development of social assistance has a history of more than 400 years,starting from the first law on poor relief issued by England in 1601,Elizabeth's poor law.The development history of the country and human society also fully shows that social assistance is indispensable for the development of a country and society.It plays a very important role in adjusting social interests,promoting social equity,resolving social conflicts,maintaining social stability and finally achieving social progress.It can be said that the development and improvement of the social assistance system fully reflects the civilization and progress of a country and society,as well as the humanistic care between groups under the domination of social attributes.However,it should be noted that the connotation of social assistance has not been fully elaborated.Social assistance is not a new thing that has gone through hundreds of years of development,but at the same time,it is a thing with increasingly rich connotation and constantly changing with the development of The Times.Just as some scholars have said:the social relief activities of human beings are always based on the material conditions of the society and the degree of civilization.With the progress and development of the society,the content and form of people's relief activities are also changing constantly.Therefore,with the development of the country and the society,the concept of social assistance is constantly giving birth to new connotations.The enrichment of such connotations is not the imposition and appendage of a water without a source or a tree without roots,but is exactly based on the painful and urgent practical needs.Spiritual succor is a new content of social succor given by the development of times.At present,the necessity and practical significance of spiritual rescue have not been well known.Even in the academic world,there are few relevant research contents.From the perspective of law,spiritual assistance to protect the interests of the personality right,based on the analysis of its necessity and realistic demand,spiritual assistance shall be a legal system to be present,but the system of legal system should be how to face present in our country's social assistance legal system and what's the content of the concrete system,remains to be seen to clear.Therefore,this paper tries to solve the following three problems:(1)it tries to discuss what spiritual relief is,and explains the necessity of the construction of the legal system of spiritual relief as fully as possible;(2)never adults and adult students,major natural disasters,and the subjects of sudden social events,criminal cases,loss of family,economic social vulnerable groups,and not have some special identity of these six kinds of main body,this paper analyzed the present our country social the reality demand for spiritual relief,and focus on the research in the present system of social assistance policy laws and regulations of our country with the spiritual assistance system situation of these six kinds of main body;(3)discuss the construction and improvement of the legal system of spiritual relief in China,and explore the choice of its legislative model and the design of system contents.With social hot issues as the breakthrough point,such as literature analysis,comparative analysis,historical analysis,the text analysis as the main research method,study to the problem,in this paper,the following conclusions:(1)clear what is a spiritual assistance:spiritual relief is the component of the system of social assistance system,refers to a serious psychological problems to solve by rescuers current pressing and prompt it to participate in daily social life nonnal mental state as the goal of rescue,the relief way,is a professional psychological state regulate behavior,the purpose is to solve the hamper relief objects for normal social life of psychological problems and mental disorders.(2)explain the necessity of establishing the legal system of spiritual relief:Human has the basic spiritual needs in daily social life,the basic spiritual needs is not equal to spiritual pursuit,and it also belongs to people's basic life safeguard scope,from the perspective of interests,it belongs to the protection of the rights of personality right and therefore it is necessary to build spiritual relief legal system,in addition,in view of the present situation of the six main investigation also shows that the current our country social existence spiritual relief the realistic need,however,China's social assistance legal system to the real need is lack of attention and response,in the present our country legal laws and regulations policy system,mental relief to the attention of a few.(3)make a proposal on the improvement of the legal system of spiritual relief in China:it is advisable to adopt decentralized legislation in the legislative model,and try to explore the contents of the subject,object and approach of relief.
