Research On Business-run Enterprises And Their Governance In Violation Of Regulations By Relatives Of Leading Cadres

Since the reform and opening up,China has developed economy vigorously.Meanwhile,China has also made unprecedented achievements in the fight against corruption.However,relatives of leading cadres doing business and running enterprises illegally have become a great obstacle in the road of anti-corruption.As a result,the order of the socialist market economy has been destroyed.These actions have violated the principles of fair and equal competition.What's more,it is easy for illegal enterprises to breed corruption phenomenon,such as benefiting oneself at the expense of public interests,dealing power for money,tunneling problems and so on.The good images of the CPC and the government in people's minds have been seriously damaged.These illegal actions will ruin a number of people and have negative effects which are particularly serious.It is a key measure to standardize the actions of the relatives of leading cadres in business to prevent officials from corrupting and build a government of righteousness and justice to improve the Party's style of work.Actually,it is also a protective measure for leading cadres.It is a system engineering to govern the relatives of leading cadres doing business and running enterprises illegally.Therefore,solving the problems need multiple measures and multi-pronged approaches.The thesis consists of five chapters.Chapter one is an introduction.This chapter mainly introduces the background,selection reason,domestic research status,research method,the innovation and disadvantage.Domestic researchers have researched the problem about leading cadres' relatives doing business.On the one hand,their researches provide important and useful reference for my project.On the other hand,I have found that their studies have some theoretical and practical insufficiency.Their opinions need to be further studied and discussed.At first,Chapter two has defined the main concepts used in the article.The concepts mainly involve:leading cadres,leading cadres' relatives,leading cadres' relatives doing business illegally.In this writing,the concept of leading cadres' relatives refers to the close relatives,including spouses,parents and children.Meanwhile,it also includes children's spouses.Then the paper has introduced and analyzed the correlative theories about regulating relatives of leading cadres doing business and running enterprise illegally.The theories mainly include different sequence theory,conflict of interest theory and the level of political institutionalization theory.The basic value orientation of this paper is to promote the level of political institutionalization.Based on this,the paper has studied and discussed the problem of leading cadres' relatives doing business.Chapter three has combined quantitative analysis and qualitative evaluation to describe the current situation of leading cadres' relatives doing business illegally.The article mainly presents and explains from four dimensions:the form of representation,the basic characteristics,the result of governance and the analysis of some cases.Combining data analysis with cases study,it is found that there exists a high degree of correlation between relatives doing business illegally and leading cadres' downfall.And then,the paper generalizes the negative effects of leading cadres doing business and running enterprise illegally.Specifically speaking,there are mainly four aspects.Firstly,the Party's purity is weakened.And the representativeness is distorted.Secondly,the political ecology is polluted.At the same time,the violations may also lead to "broken window effect".Thirdly,our Party and government will fall into "Tacitus Trap".Certainly,social capital will also lose.Fourthly,it will corrupt the cadre troop.Without doubt,the kinship will dissimilate.Chapter four continued from the preceding paragraphs,analyses the deep reasons of leading cadres' relatives doing business illegally.Economic factors,institutional factors,cultural factors and the factors of leading cadres themselves are complicated and interactive.Objectively,the main reason include the imperfect inner-party regulations and normative documents,the low cost of leading cadres'relatives doing business illegally and the power abused by capital fetishism.In fact,for the leading cadres whose relatives do business and run enterprises illegally,most of regulations only stipulate that punishment will be given by Party and administrative discipline agencies.High profit and low risk are the main factors that cause the in the normal state.Thirdly,perfect rules and regulations.In particular,we should implement property declaration and publicity system.Fourthly,strengthen public employee's ideals and beliefs.At the same time,pay attention to the construction of family education and family culture.According to the above researches,this paper puts forward the main point in conclusion paragraph.This paper believes that we should clarify the boundary whether leading cadres' relatives do business and running enterprise legally or illegally.It is an important mission to promote the level of political institutionalization.Thus,the emphasis is "norm" when we guide the actions that relatives of leading cadres do business and run enterprises.When we prevent leading cadres' relatives from seeking illegitimate interests,their legitimate rights should be guaranteed.Governing the problem that relatives of leading cadres do business and running enterprise illegally is an important measure to keep
