Research On The Construction Of The Rule Of Law For Poverty Alleviation And Development In Ethnic Areas

Since reform and opening-up,our country has been committed to the development of poverty alleviation in ethnic minority areas,since poverty alleviation and development,poverty alleviation in ethnic minority areas has obtained great achievement,also,poverty alleviation and development of the rule of law construction in our country such as the continuous improvement of the local poverty reduction policy,the construction of the poverty alleviation mechanism,supervision and management of poverty alleviation funds,poor areas poverty alleviation for the improvement of the rule of law consciousness,judicial safeguard mechanism and improve the poverty alleviation and development and so on.However,there are still some problems in the process of poverty alleviation work,such as the lack of poverty alleviation legislation,non-standard poverty alleviation implementation process,prominent corruption,weak awareness of the rule of law and so on.These problems are still the difficulties to be overcome in the construction of the rule of law for poverty alleviation in ethnic minority areas.Ethnic minority areas are contiguous poverty-stricken areas.They are the main battlefield of poverty alleviation during the 13th five-year plan period.They are the weak link in poverty alleviation and the building of a moderately prosperous society in all respects.As the work of poverty alleviation and development enters the crucial period,it is particularly important to establish the legal working mechanism of poverty alleviation and development in ethnic minority areas.Ethnic minority areas,as the key areas of poverty alleviation and development,especially the "old,young,border,poor and reservoir" areas such as Hechi city in Guangxi,are the focus of poverty alleviation and the difficulty of poverty alleviation as well as the typical types of poverty alleviation.Therefore,it is not only an inevitable requirement for ethnic minority areas to get rid of poverty,but also an empirical support for the development of national poverty alleviation.In this paper,the author will expound the legal construction of poverty alleviation and development in ethnic areas through four parts.Comb through poverty alleviation and development related concepts and theories,analyze the poverty alleviation and development from the perspective of jurisprudence and the rule of law,the relationship between the paper expounds the necessity of poverty alleviation and development of the rule of law construction,combining with the status quo of the legislative status quo of China's poverty alleviation and development and practice,in the Guangxi zhuang autonomous region Hechi district as an example,the mining problems inHechi city poverty alleviation work,as well as the effect of poverty alleviation and development,the scale of transformation,promoting poverty alleviation system are put forward based on the problems existing in the construction of corresponding advice.The first part:the basic concept of the legal construction of poverty alleviation and development in ethnic minority areas,analyzes the meaning of poverty alleviation and development in ethnic institutionalization,and clarify the rights and obligations between the subjects.Secondly,it analyzes the necessity of the legal construction of poverty alleviation and development in ethnic minority areas.The legal construction of poverty alleviation and development is an important guarantee for poverty alleviation in ethnic minority areas,the need to solve the practical problems of poverty alleviation and development in ethnic minority areas,and the key to realize the institutionalization and standardization of poverty alleviation and development.Again from the legal system for guiding the poverty alleviation and development of the legal system,guided by the concept of fairness and justice,poverty alleviation and development of executable program,ensuring the citizens' rights of minority areas in different periods,analyzes the achievements and existing problems in the rule of law construction of poverty alleviation and development in ethnic minority areas since the implementation of poverty alleviation and development,and analyzes the factors causing the deficiency in the rule of law construction of poverty alleviation and development in ethnic minority areas.The third part:This chapter takes Luocheng mulam autonomous county,Huanjiang maonan autonomous county and Duan yao autonomous county as examples to conduct investigation and demonstration.By sorting out the poverty alleviation process in Guangxi zhuang autonomous region and Hechi region,the current laws and policies of poverty alleviation and development in the region are understood,the legal construction of poverty alleviation and development in Guangxi is comprehensively investigated,and the achievements made since the implementation of poverty alleviation and development in Hechi region are summarized.Through investigation and case analysis,it points out some problems of poverty alleviation and development in Hechi area.The fourth part:Promoting the path of legal construction of poverty alleviation and development in ethnic minority areas.In view of the existing problems in the legal construction of poverty alleviation and development in ethnic minority areas discussed in this paper,the legal construction of poverty alleviation and development in ethnic minority areas is promoted by building a sound legal system of poverty alleviation and development,improving the supervision mechanism of poverty alleviation and development,strengthening the team building of poverty alleviation and development,and enhancing the legal consciousness of poverty alleviation and development in ethnic minority areas.
