Legal Regulation Of Poverty Alleviation And Development In The Poverty-stricken Ethnic Minority Areas

There is currently certain necessity of the legal regulation of the poverty alleviation and regional development in the impoverished region of ethnic minorities because of the law predicament with the incompleteness of its legal interpretation and citations based on the particularity and complexity in this region.This paper aims to regulate the legal issues for poverty alleviation in developing minority, mainly includes the following four research issues:①the poverty and the poverty alleviation of minorities;②the necessity and feasibility of the legal regulation of poverty alleviation and region development;③the Intensional Semantics of this legal regulation;④the strategies of this legal regulation.The main conclusions in this paper are:(1) The establish and improve the poverty-stricken minority areas of poverty alleviation and development of existing legal regulations based on laws and policies, but also practical support feasible.(2) The minorities in poor areas of poverty alleviation and development legal regulation should be dominant norms of civil law, civil law should be on poverty alleviation and development to regulate the most important institutional origins. Poverty alleviation and development of regulatory norms, the authority to deal with regulators limited, there must be clear accountability mechanisms.(3) The law is necessary to give full play to the role of the existing legal system in the regulation of poverty alleviation and development, but also can not ignore the practical utility of local regulations and policy resources has been achieved, but also pay attention to learn and absorb other countries and regions, poverty alleviation and development of agricultural land laws and regulation reasonable system.(4) When setting up the legal system of the main poverty alleviation and development, should be the subject of rights is based; poverty alleviation and development in the process of setting system should adhere to the principle of autonomy; poverty alleviation and development in the specification of the object, should fully reflect the number of national poverty alleviation and development in poor areas of public service nature.
