Research On The Civil Law Protection System Of Privacy Rights Under Facial Recognition Technology

As an important part of biological recognition,face recognition technology has its unique virtues in both commercial applications and public services.Nevertheless,the constantly developing big data application technology has increased the exposure of personal data day by day.Once the data is disclosed or missing due to imprudence,it will lead to great inconvenience to our social life like endless harassment phone calls,unauthorized use of a credit card,and even the threat to personal safety.Under the main circumstance of face recognition technology,we should regard raising the threshold of personal data collection as the focus of privacy-protection,establishing more regulations to restrict data controllers so as to protect personal data security.However,due to the lack of relevant legislation and the characteristics of facial recognition technology which are different from other technology infringement approaches,there is still much room for improving relevant laws about protecting the citizen's privacy right under the emerging technology.This paper explores the causes of privacy infringement risks and existing problems,then makes a discussion from the perspective of civil law protection,and finally comes to relevant improving measures by studying the application and development background of facial recognition technology and discussing the potential infringement risks of this technology with relevant typical cases.This paper consists of five parts.The first part is the introduction,which elaborates the background and significance of the topic selection,the research status at home and abroad,research methods,innovation and deficiencies.Chapter two briefly narrates the issues related to privacy under face recognition technology,analyzes the current status of infringement,and summarizes the features of face recognition technology like diversified subjects and concealed way of infringement.Chapter three discusses the social problems caused by facial recognition technology infringement through discussing typical cases,and extends to the exploration of privacy paradox and the importance of the right to be forgotten.Chapter four,based on foreign countries,summarizes and analyzes the advanced experience of the EU and the United States,and then studies its reference significance to China's relevant regulations.Chapter five,by telling the current legislation status in China,analyzes the problems and dilemmas in the protection of privacy under civil law under face recognition technology at the present stage.Then it sums up the corresponding measures to further improve the protection of privacy right considering realities of China.
