Research On The Reform Of The "large Comprehensive" Administrative Law Enforcement System In The Shanghai Pilot Free Trade Zone

The comprehensive administrative law enforcement is an important content of deepening the administrative law enforcement system reform and is also one of the important carriers of constructing a law-based government.The comprehensive administrative law enforcement system practiced by Waigaoqiao free trade zone is a “big-comprehensive”law enforcement system.This is a brand-new exploration in Shanghai,even in the mainland of China.This paper,by reviewing the whole governance theory,centralization and decentralization theory,provides theoretical support and reform ideas for the practice of comprehensive administrative law enforcement system reform.Coordination and integration,responsibility,information technology development are the important factors of the whole governance theory.Centralization and decentralization theory explains the allocation of administrative law enforcement power theory and centralizes law enforcement power based on decentralization of examination and approval,law enforcement and supervision.In this paper,choose the reform of "bigcomprehensive" administrative law enforcement system in Waigaoqiao free trade zone as the research object,take "functional remodeling-process reengineering-technical reformation-mechanism innovation" as the reform path,and summarize the main methods of comprehensive administrative law enforcement system reform in Waigaoqiao free trade zone.The research methods such as interview are used to analyze the achievements and problems in the reform of China(Shanghai)pilot free trade zone,including the lack of legal basis and mechanism,the lack of internal and external cohesion and the unclear limit of authority,the lack of supporting reforms and the need to strengthen the management of law enforcement teams.This paper makes a comparative study on the experience of the reform of administrative law enforcement system in "Pingtan Model" in Fujian and "Qianhai Model" in Guangdong.On this basis,this paper makes a few suggestions from five aspects: perfecting legal guarantee,defining the limits of authority,establishing the mechanism of law enforcement cooperation,perfecting the supporting reform measures and strengthening the professionalization of law enforcement team,in order to provide a theoretical analysis and empirical research report for the reform of the “bigcomprehensive” administrative law enforcement system in China(Shanghai)polit free trade zone and to provide reference for others in China mainland,especially in Lin-gang special area of China(Shanghai)polit free trade zone.
