Personal Information Risks And Administrative Regulations In The Open Government Data

With the development of internet technology and big data,Government Data Opening is increasingly popular and prevalent.Government Data Opening is an important data utilization,which provides the crucial basis for data communication and data-based industry.The issue of personal information security is a prominent issue in Government Data Opening.If we can not properly balance the relationship between Government Data Opening and personal information protection,it will eventually hinder the development of Government Data Opening,which is not beneficial to the development of China's digital economy and democratic politics.On the basis of examining the dynamical process of Government Data Opening,this paper analyzes the approaches of personal information protection in the opening stage and utilizing stage of Government Data Opening from the perspective of data flow.Since Government Data Opening is different from Government Informational Publicity in open purpose,open object,and open form,based on traditional identifiability feature,personal information has new characteristics such as sheer volume,high accuracy,and convenient access which makes the risk of personal information increase sharply and bring new risks of unreasonable opening and re-identification in the opening or utilizing stage.In view of the new risks faced by personal information in Government Data Opening,this paper explores the regulatory focus and countermeasures of personal information protection based on extraterritorial experience and domestic systems.In the opening stage,we should get to the key to the scope of opening,clarify the principle of Data Minimization,establish a hierarchical protection system,establish a privacy impact assessment mechanism,and establish a data openness special agency.In the utilizing stage,we attach importance to prohibiting re-identification behavior and we ought to establish a credit evaluation system,a data licensing agreement system and a personal information protection institution,and develop industry standards of government data utilization.
