On The Realization Of The Social Security Rights Of The Urban Floating Population

With the rapid development of the socialist market economy,it has brought a lot of capital dividends and also caused a series of social problems.What is more representative is that the development of the social security system cannot keep pace with,and people's social security rights are difficult to be fully implemented,especially for the growing floating population,they are also the main body of social security rights,but they are in a relatively weak position.Based on this,this paper first defines the concept of floating population and social security right,analyzes the basic characteristics of social security right from the relevant theories of social security right,and then discusses the meaning and nature of social security right,makes clear the subject of rights and obligations of social security right,and analyzes the characteristics of social security right of urban floating population through comparative study.Second,analyze the problems in the process of realizing the social security right of floating population.Through the analysis of the floating population to social security legislation situation,found that aimed at the problem of floating population to social security legislation deficiencies,namely social security legal system is not fully established,embodied in the constitution expressly to social security and the effect of these legal documents related to the social security is not high and the lack of overall importance.The deficiency of legislation leads to the unsoundness of right relief,which is embodied in the lack of legal basis.Through the comparison with the realization of the social security right of the non-floating population,it is found that the floating population in the realization of the social security right of the social insurance participation rate is not high and difficult to transfer and continue the problem,in addition,there is also the floating population and the non-floating population social welfare treatment of inequality,the floating population social assistance system is missing.Third,the causes of the aboveproblems are analyzed and found to be closely related to the behavior of the subjects of social security rights and obligations,the consciousness of the subjects of rights,the defects of the social security system and the management mode of the household registration system.Finally,the author puts forward the following countermeasures:the obligatory subject of social security right should actively promote the legislative work in different fields of social security right,and define the social security right in the constitution in order to build a complete social security legal system;Improve the administrative relief and judicial relief of social security right;Construct a complete social security system,break the system of identity and the protection of regional interests;We will push forward the reform of the household registration management system,appropriately relax the requirements for household registration,and separate the household registration system from social welfare and social assistance.To build a service-oriented government and improve the level of social governance so as to effectively promote the equalization of public services.In order to truly implement the social security rights of floating population,help them not to be infringed,better integrate into society,and serve the social economic development.
