| The transfer of rural land contracting and management rights concerns the vital interests of all subjects,especially farmers,which has been receiving widespread attention from the Chinese government and all walks of life for a long time.However,in recent years,the problem in this field is increasingly coming up.The most significant reason is that the current inadequate transformation of township government functions has become a bottleneck factor restricting the transfer in China.As the nerve endings of China’s administrative system,township government plays a crucial role in governing the transfer of land contracting and management rights.This paper takes the township government functions in the transfer of rural land contracting management rights as the research object,and combines the empirical analysis of the township governments of Haimen City,Jiangsu Province.Firstly,the relationship between the transfer and township government functions is expounded.Secondly,through text analysis and interview survey,this paper focuses on the historical evolution of Haimen’s township government functions in this field.Thirdly,this paper analyzes the current problems in Haimen’s township government functions from four aspects: functional relationship,functional content,functional structure and functional mode,which is the top priority of this paper.On this basis,it also analyzes the four causes,namely the imperfection of relevant laws and regulations,the impeditive effect of Confucian "Li" on the rule of law,the fragmented operation of township government under the bureaucracy structure and the alienation of governance objectives under the performance appraisal mechanism.Finally,in view of the existing problems and reasons,four countermeasures are proposed to optimize the functions of the township government from four aspects: strengthening the institutional guarantee for the transfer of land contracting management rights,optimizing the governance concept of township governments,deepening the reform of grassroots administrative system and constructing the governance system of multi-subject interaction. |
