Since twenty-first Century,China has carried out a number of reforms in the field of higher education,which has made remarkable achievements,but there are still many problems to be solved.The root of some of the problems comes from the effective division and establishment of the power of the government and colleges and universities in the field of higher education.Therefore,in the field of higher education,the reform of government decentralization is necessary.At the present stage,the government's decentralization work in the management of higher education is mainly carried out through two aspects: the promulgation of the guiding policy text and the formulation of specific list of rights.In the central government,the five sector of the government reforms and promulgates related policies through "letting go of services" to further deepen the reform of decentralization.The Ministry of Education issued the list of rights to publicized the rights and transfer rights of the government to the public.Under the guidance of the central government,the local government also formulated and issued the guiding policy texts according to the provincial conditions,and made power lists or other forms of power.Guangdong province through the list of power and the list of responsibilities,Zhejiang through the issue of the transfer of education,the transfer of educational power,Shandong province through the form of power list and information form,not only delegate the power of running schools,but also embodies the characteristics of the school.From the analysis of the above government's content of running the right to run a school,the higher management of the government has evolved into two forms.The government is responsible for the key problems of running a university through administrative examination and approval,and the other government in the internal management of the school realizes the regulation and control through supervision and punishment.However,there are still many problems in the process of the decentralization of government power,and the overriding phenomenon of government administrationhas not been eliminated.The limit of power between the government colleges is not clear,it is easy to cause the phenomenon of the blank of the power belonging after the decentralization;the government has not set up the corresponding responsibility system for the government to decentralize the right to run a school.And accountability mechanisms.The reasons for the above problems can be divided into three aspects: first,the lack of legal protection,the lack of detailed interpretation and explanation of the legal provisions in educational legislation;the existing legislative model is easy to produce other powers,except for the power of the colleges and universities,which belong to the government's thinking inertia;the legal vacancy and the law are more important.The new lagging phenomenon is serious.Second,colleges and universities are weak in safeguarding their rights,and colleges and universities can not get rid of the "wait for" inertia to rely on the thought of the government.The principals are appointed by the higher authorities,the posts are linked to the administrative level,the administration makes the headmaster obey the "superior" management,the University constitution is formalized,and has not played the role of protecting the rights and interests of colleges and universities.Third,the essence of government decentralization is insufficient.The idea of standard management of university administrators has not yet been changed.The time of decentralization is short and the power of decentralization is not enough.The government lacks clear positioning.Therefore,the government should put up the power of running schools and implement the reform of the separation of management and evaluation.First,the government should change the role of the government and build the opportunity of the service government to realize the transformation of the function orientation from the scholar to the manager,and turn the heavy administrative management into the heavy supervision and management.Secondly,we should improve the legal system of higher education and the system of the rule of law in education,set the power of the government and colleges and universities with a strict and scientific way,and ensure the implementation of the efficient running power by legal means.Third,we must improve the ability of independent education,improve the University Charterand maintain the power of running colleges and universities.Finally,we should carry out the three list management mode,determine the power of the government by the list of power,guarantee the school running right with a negative list,perfect the responsibility system with the list of responsibilities,three list of lists to work together,and ensure the operation of the power standard.
