Research On The Protection Of Internship Rights Of Secondary Vocational Students

In today's era of vigorous development of market economy,the development of vocational education is also an important criterion to measure a country's educational development level and comprehensive national strength.Secondary vocational students' practice is an important transitional stage from theory to practice.It is conducive to testing the knowledge of secondary vocational students,enhancing their practical ability,and improving their ability to adapt to society.At present,China has not yet established a sound intern management system.There are many defects and deficiencies in the current laws and regulations on the protection of interns' rights and interests.Most of the practice management work in schools pays too much attention to the surface and pursues the rationality of the form,but neglects the essence of the practice work,which can not meet the needs of the students' skills and the accumulation of social experience.Interns are often sent to factories to do various kinds of chores,which not only makes their practical operation ability not get exercise,but also wastes valuable time.The internship unit undertakes the responsibility of skill training and safety assurance for interns.However,some interns do not actively fulfill their responsibilities and accept interns in order to reduce or exempt tax.But when these interns arrived at the enterprise,the enterprise let it go and let it grow and die.In case of injury accidents,enterprises will do everything possible to shirk their responsibilities at the first time.However,the departments such as the Education Bureau and the Labor Bureau,which are responsible for the supervision of students' internship,often fail to fulfill their supervisory functions,fail to detect the tax fraud of enterprises and the profit-making behavior of schools,or pass the buck on each other because of their unclear understanding of their functions and fear of taking risks,leaving the intern units or schools to ignore the violation of interns' rights.In this way,people will gradually lose confidence in the government,thus aggravating the occurrence of various social contradictions.In a word,the imperfection of the internship system in our country increases the possibility of the interns' rights and interests being infringed,and also makes it more difficult to deal with the accidental injuries that occur during the internship.If the rights and interests of vocational school students are not well protected,it will directly affect the development of vocational education.Therefore,how to safeguard the students' internship rights has become a critical,complex and urgent problem both in theoretical and practical aspects.This paper is mainly based on the case study method,meanwhile using the literature research method and the interview analysis method.Firstly,it defines the concepts related to the internship of vocational school students,clarifies the concepts and types of the legal relationship of vocational interns as in labor's identity and the basic connotation of the internship rights.Based on the countermeasure research,this article mainly aims at the particular group--the vocational interns.The study is carried on according to the present infringement situation and the infringement reasons of the vocational students during their internship.In the hope of providing help to various problems of infringement of the rights and interests of the vocational school students,we try to seek the solution from five aspects: the society,the schools and students,the government departments and internship units.
