As knowledge has played an increasingly important role in the current social and economic development, the tide of "learning revolution" has spread across the world. The rapid development of knowledge-based economy motivates people to have an increasingly high expectation of learning knowledge. In the meanwhile, people also show incredible passion for learning skills. Under this circumstance, the learning rights have turned from unimportant rights into fundamental human rights. For vocational students who have a special position in higher education, they have poorer learning foundation and less learning enthusiasm and initiatives, compared to the students in universities. However, whether vocational students’ learning rights and interests could be protected is not only connected with students’ personal development for the rest of their lives, but also related to the enhancement of manufacturing level and the reconstruction and development of new industries. As a result, the responsibility for effectively protecting vocational students’ learning rights and interests is given to relevant administrative departments, vocational schools, society and students themselves.This research has adopted various research methods, including literature review method, questionnaire method and interview method. It also selects four schools in Chongqing and Qingdao as respondents. The questionnaire is about the current situation of vocational students’ learning environment in school, which is conducted from three perspectives, including "showing respect for students’multi-dimensional development and embracing differences","the cognition and implementation of learning rights", and "the security and relief payments of learning rights", in order to figure out the key problem in the process of protecting vocational students’learning rights and interests, and to analyze of reasons. Eventually, this paper will put forward some solutions and suggestions on improving the construction of the security system of vocational students’learning rights and interests in our country. In addition, compared to the other studies on this topic, this research not only pays attention to vocational students’ normal learning rights and interests, but also conducts both a survey and an analysis of the security condition of the learning rights and interests of vocational skills which is the most important to students. Then the protection strategies are brought forward.In accordance with the research, our nations have made some achievements in protecting the vocational students’ learning rights and interests, while there are still a lot of problems, such as "the unitary evaluation system","insufficient space for individual development","the barriers that prevent students from achieving multi-dimensional development","the absence of the protection of students’ learning rights and interests caused by teachers’ poor perception of students’ learning rights and interests","difficulties in reflecting vocational students’learning characteristics by focusing on theory rather than practices and emphasizing the form rather than process"," the lack of effective protection of students’ learning condition, which prevents the learning rights from being realized","the incomplete relief approach and imperfect relief system make it difficult for students to fight for their rights and interests" and so on.The reasons for the problems could be divided into three types. The first reason lies in the individual perception. Students still lack the consciousness of rights, which leads to the poor initiatives to realize learning rights. The second reason lies in the teaching management of school, which includes the inadequate learning resources, low utilization rate and the need to improve teachers’ professional competence. In addition, the regulation, rules and law are the third reason. The relevant law and regulations are inadequate, besides the legal supervision is deficient. Based on the analysis of the different types of reasons, this research will put forward some strategies from five aspects, including "promoting the consciousness of rights and interests among teachers and students, improving the perception of fighting for rights","establishing the positive multi-dimensional evaluation system and making students step from the edge to the center of evaluation system","pushing forward the reform of class teaching, improving the vocational skills teaching quality","building the win-win cooperation system between school and enterprises, cultivating the ’double-qualified teachers team"’ and "establishing and optimizing the legal regulations related to education and helping students to find the new approach to protect students’ rights and interests", so as to facilitate the better protection of vocational students’learning rights and interests.
