Economic compensation is based on the termination and termination of labor contracts.The establishment of economic compensation system involves not only the survival and interests of workers,but also the respect of employers for workers.This respect is shown in the payment of money,when the employer violates the agreement of the two parties labor contract,early termination or termination of labor relations should pay economic compensation,which is also the legal responsibility of the employer.Social division of labor has promoted the economic development,the occupation category has increased sharply,and the employment mode has presented a complicated situation.The "one belt and one road" and the Internet era bring new problems to the termination of labor employment system and labor relations,so it is necessary to conduct in-depth research on the issue of economic compensation.The core of payment of economic compensation is the issue of interests.The existing economic compensation system has been generalized from simple to continuous perfection,and has defined the nature of labor disputes from too general and extensive to specific details.However,new problems still exist in judicial practice,such as the widespread use of labor dispatch system,restrictions on competition and part-time employment.With the development of society,many new problems have to be put forward.This article intends to make a legal analysis of economic compensation,analyze the conditions of payment of economic compensation,clarify the calculation standard of economic compensation,and solve practical problems by judicial cases.Especially the disputes encountered by a large number of dispatched employees in the labor process and the phenomenon that employers ignore labor laws and evade laws are generally analyzed.Comparing with the "economic compensation" of other countries,this paper puts forward the blind spot and vacancy of the economic compensation system,and makes a beneficial attempt to perfect the economic compensation problem,restriction of competition and dispatch of labor services,puts forward reasonable suggestions,and draws a more practical conclusion in order to solve the economic compensation theory and judicial practice.Problems in China.
