The advance payment system of industrial injury insurance fund not only perfects the industrial injury insurance system itself,but also fully protects the labor rights and interests of the injured workers,provides more timely relief for the injured workers,and reduces the burden of litigation of the injured workers and saves judicial resources.The implementation of this system plays an important role in guaranteeing people's livelihood,promoting economic prosperity,maintaining social stability and development.Since its implementation in 2011,the system has achieved certain results,safeguarded the legitimate rights and interests of workers,and guaranteed the corresponding treatment of injured workers after work-related injuries.However,due to its own shortcomings,the system has been difficult to give full play to its due role.On the basis of introducing the advance payment system of Shanghai Industrial Injury Insurance Fund,this paper thoroughly analyses the current situation,problems and causes of the system,and expounds many risks existing in the advance payment system,such as unjust enrichment risk,system design risk and fund safety risk.Through the analysis of the problems,this paper probes into the reasons behind the problems,such as the incentives of the system.Lack of sex,lack of coordination between systems,lack of security of systems and so on.At the same time,drawing lessons from the relevant German practices with a long history and successful experience in this respect,using the methods of literature research,questionnaire survey and comparative study,and from the perspective of the theory of synergistic governance,the paper puts forward feasible suggestions on the improvement of the advance payment system of Shanghai Industrial Injury Insurance Fund from the aspects of subject,application,supervision and recovery,and finds out the corresponding countermeasures.Strategy.It can be seen that although the law gives workers with industrial injury the right to apply for the payment of industrial injury insurance fund in advance,Shanghai is also steadily promoting the improvement and implementation of the payment system of industrial injury insurance fund in advance.However,the problems arising from the actual operation show us that the system still has a lot to be improved.Therefore,we hope that through this article we can promote the industrial injury insurance fund payment system in Shanghai and even the whole country can truly develop andimprove,and truly become the "gospel" of the majority of industrial injury workers.
