More than 40 years of reform and opening up have enabled the rapid development of China's socialist market economy.employers play an important role in promoting social development.The employee is the most active factor in the production and operation of the enterprise.Specifically speaking: unit of choose and employ persons issues instruction to laborer,laborer is engaged in a job according to the requirement of unit of choose and employ persons,create value for the enterprise.However,China's current laws and regulations on the right of recourse of employing units of the provisions of the legislation is vague,mainly reflected in: whether the employing units enjoy the right of recourse,and the scope of the right of application of the boundary where.This paper analyzes the above problems through literature analysis,case study and comparative analysis,and compares the legislative status of employing units' right of recourse in foreign countries.This article mainly through the literature analysis and the purpose analysis to carry on the analysis to the above problems and according to the present situation of our country puts forward the corresponding Suggestions.This paper is divided into three parts: first,this paper takes the vicarious liability of the employing unit as the entry point.Secondly,it analyzes the rationality of the right of recourse of the employing units.Finally,based on the national conditions of our country,taking the constitutive requirements,restrictions and forms of the right of recourse of employing units as the breakthrough point,this paper defines the system of the right of recourse of employing units in our country,carries out legal conception,and puts forward specific legal Suggestions.
