Household contract responsibility system is thought of as the symbol of the first reform in rural China.The initial reform in cities learned from China's reform in rural areas.However,since then,the reform pace in rural areas had been lower than that in cities.Currently,production factors such as,rural labor force rural land and other resources have not yet achieved market.Meanwhile,household contract responsibility had greatly liberated the production enthusiasm of farmers by operating independently but also strengthened the status and role of family peasant economy.The advantages of family peasant economy had faded away gradually and its disadvantages appeared:such production and management system in rural China was not suitable for joint market,popularization of agricultural technology,saving cost of agricultural production,and increasing agricultural productivity.Because of this,the transfer of rural land contract right was destined to become the internal demand of the second reform in rural areas and the ways of commercialization of rural production factors.As we all know,agriculture is a kind of vulnerable industry,villages are weak and famers are vulnerable groups.It cannot be achieved of rural areas highly developed by agriculture,villages and famers themselves.On the contrary,the rational choice is dealing with rural dilemma by the commercialization of all production factors in rural areas.Thus,it is the internal requirement of improving the household contract management system to regulate rural land transfer and promote its large-scale operation base on household contract responsibility system,which is also the only way to become prosperity of agriculture,villages and famers themselves.In this macro-economic background,based on market economic theory,institutional change theory,property rights economics and transaction cost economics theory and a large number of previous research results,the paper briefly analyzed the history,status and problems of rural land transfer in China.Furthermore,the paper focused on constraining factors and their effects in rural land transfer market from perspective of formal intuition and informal intuition combined with theoretical analysis and regional practice.And last,ideas and suggestions were proposed on intuition innovation of rural land market.Case analysis,comparative analysis,normative analysis and empirical analysis were widely used in this paper.This paper can be divided into seven parts,as flows:Chapter 1 is introduction which introduced the background,purpose and significance of the writing.Chapter 2 explained the basic understanding and theoretical basis of rural land transfer and market construction,such as,the connotation and extension of contractual management right of rural land,rural rand transfer and market of rural land transfer,the necessity of rural land transfer and its market construction,basis in reality of rural land commercialization,the theoretical foundation of the writing.Chapters 3 analyzed the history,status and problems of rural land transfer.Firstly,the history of rural land transfer since 1978 when household contract responsibility system was implemented was divided into four stages according to different regulations on rural land transfer by laws and policies.Secondly,the status of rural land transfer in China was introduced,including national and regional wide.Thirdly,some problems on rural land transfer and its market construction in some regions were analyzed.Chapter 4 focused on the negative factors of formal intuition affected on rural land transfer and market construction of rural land,including rural land-property relations,market mechanism,laws and regulations,and other relate systems.Chapter 5 focused on the negative factors of informal intuition affected on rural land transfer and market construction of rural land,including ability and awareness of government,informal intuitions in villages and regional socio-economic development environment.Chapter 6 analyze intuition innovation of rural land transfer market base on the conclusions above and the actual situation of social and economic development level in rural areas,including the principles of intuition innovation,market mechanism of rural land transfer and related measures.Chapter 7 is conclusion which summarized and organized the main research conclusions and results in this paper.
